RESOLUTION NO. 2003-508
ACCEPTING THE STREET AND UTILITY CONSTRUCTION
PLUM TREE EAST 4TH ADDITION (20045)
WHEREAS, in accordance with the development contract dated June 28, 2000, Lundgren
Bros. Construction, Inc., developer of Plum Tree East 4th Addition (20045), has agreed to
install certain improvements for said development; and
WHEREAS, the developer has requested that the City accept the street and utilities for
continual maintenance; and
WHEREAS, project engineer has certified that the improvements were constructed in
accordance with the approved plans and specifications; and
WHEREAS, developer has requested a letter of credit be used in lieu of a maintenance
bond and has provided a letter of credit in the amount of 20% of the cost of the
improvements;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA; that the street construction is accepted for
continual maintenance as of November 10, 2003 subject to the one year guarantee by the
Developer per Letter of Credit #FGAC-00147 in the amount of $38,960 which is 20% of
the construction cost.
FURTHER BE IT RESOLVED that the sanitary sewer, watermain, and storm sewer
construction is accepted for continual maintenance as of November 10, 2003 subject to
the two year guarantee by the Developer per Letter of Credit #FGAC-00147 in the
amount of $56,560 which is 20% of the utility cost.
