RESOLUTION NO. 2003-502
REQUEST FOR PAYMENT NO. 3 AND FINAL
OLD ROCKFORD ROAD TRAIL IMPROVEMENTS
CITY PROJECT NO. 2010
WHEREAS, the City of Plymouth as owner and DMJ Corporation, as contractor, have
entered into an agreement for the Old Rockford Road Trail Improvements, City Project
No. 2010, said agreement being dated August 28, 2002; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $169,667.00 and the value of the
work to date is $156,969.07 and is herewith approved. This project does
not exceed the contract amount.
2. That the work performed by the contractor for the Old Rockford Road
Trail Improvements Project and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as
to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 3 and Final in the amount of $7,848.45 to DMJ
Corporation for the Old Rockford Road Trail Project is hereby approved
and the City Finance Director is hereby authorized and directed to pay the
same forthwith.
Adopted by the City Council on November 10, 2003.
