HomeMy WebLinkAboutCity Council Resolution 2003-499CITY OF PLYMOUTH RESOLUTION 2003-499 APPROVING THE APPLICATION, COMMITTING LOCAL MATCH AND AUTHORIZING CONTRACT SIGNATURES FOR THE DEPARTMENT OF EMPLOYEE AND ECONOMIC DEVELOPMENT'S CONTAMINATION CLEANUP GRANT PROGRAM ON BEHALF OF DOMINIUM DEVELOPMENT WHEREAS, Dominium Development is in the process of constructing Stone Creek Village, a 130 -unit apartment building located at the northeast quadrant of Highway 55 and West Medicine Lake Drive; and WHEREAS, as part of the environmental reviews for this project, it was determined that a petroleum-based contamination exists on the site and the developer will be required to clean up the soil contamination within the boundaries of the property; and WHEREAS the City of Plymouth has approved the Contamination Cleanup grant application submitted to the Department of Employee and Economic Development (DEED) on October 31, 2003, by Dominium Development for the Stone Creek Village site; and WHEREAS the City of Plymouth will act as the legal sponsor for project(s) contained in the Contamination Cleanup Grant Program to be submitted on October 31, 2003 and that the City Manager is hereby authorized to apply to the Department of Employee and Economic Development for funding of this project on behalf of the City of Plymouth; and BE IT RESOLVED that the City of Plymouth has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate project administration; and BE IT FURTHER RESOLVED that the sources and amounts of the local match identified in the application are committed to the project identified; and BE IT FURTHER RESOLVED that the City of Plymouth has not violated any Federal, State or local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice; and BE IT FURTHER RESOLVED that upon approval of its application by the state, the City of Plymouth may enter into an agreement with the State of Minnesota for the above -referenced project(s), and that the City of Plymouth certifies that it will comply with all applicable laws and regulations as stated in all contract agreements; and Resolution No. 2003-499 Page 2 of 2 NOW, THEREFORE BE IT RESOLVED that the Mayor and City Manager are hereby authorized to execute such agreements as are necessary to implement the project(s) on behalf of the applicant. Adopted by the Plymouth City Council on November 10, 2003.
