RESOLUTION NO. 2003-474
REQUEST FOR PAYMENT NO. 4 AND FINAL
COUNTY ROAD 101 LANDSCAPE IMPROVEMENTS
CITY PROJECT NO. 9005
WHEREAS, the City of Plymouth as owner and Noble Nursery Retail, Inc., as contractor,
have entered into an agreement for County Road 101 Landscape Improvements, City
Project No. 9005, said agreement being dated September 26, 2002; and
WHEREAS, the Engineer has certified her acceptance of the work and her approval of
the final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $208,925.14. Two change orders
were approved in the amount of $27,934.00 and the value of the work to
date is $236,461.79 and is herewith approved. This project does not
exceed the revised contract amount.
2. That the work performed by the contractor for County Road 101
Landscape Improvement Project and certified to the Council by the
engineer as acceptable, being the same, is hereby released from the
contract except as to the conditions of the performance bond, any and all
legal rights of the owner, required guarantees and correction of faulty
work after final payment.
3. Request for Payment No. 4 and Final in the amount of $19,555.85 to
Noble Nursery Retail, Inc. for the County Road 101 Landscape
Improvement Project is hereby approved and the City Finance Director is
hereby authorized and directed to pay the same forthwith.
