RESOLUTION 2003-457
APPROVING A PRELIMINARY PLAT FOR DEAN JOHNSON FOR "WYNFIELD PLACE",
A 69 -UNIT RESIDENTIAL DEVELOPMENT TO BE LOCATED WEST OF NORTHWEST
BOULEVARD (COUNTY ROAD 61) AND NORTH OF WEST MEDICINE LAKE DRIVE

WHEREAS, Dean Johnson Homes has requested approval of a preliminary plat for Wynfield
Place, a plat of 71 lots for 56 townhouse units, 13 single-family dwellings and two common area
lots on 15.42 acres located west of Northwest Boulevard and north of West Medicine Lake
Drive; and
WHEREAS, the property is legally described as follows:
The southerly 360 feet of that part of the Northwest Quarter of the Southeast Quarter of
Section 10, Townhip 118, Range 22, lying between the North 232 feet and the South 233
feet of said Quarter -quarter, EXCEPT that part thereof lying southerly of the centerline of
the town road running in a northwesterly direction across the above described parcel of
land.
The East 583.4 feet of that part of the Northwest Quarter of the Southeast Quarter of
Section 10, Township 118, Range 22, lying between the North 232 feet and the South 233
feet of said Quarter -quarter, and lying easterly of the centerline of the town road,
EXCEPT the South 360 feet (measured from the North line of said South 233 feet of said
Quarter -quarter) of said Quarter -quarter.
That part of the Northwest Quarter of the Southeast Quarter of Section 10, Township
118, Range 22, lying between the North 232 feet and the South 233 feet of said Quarter-

quarter and lying east of the centerline of the town road and west of the East 583.4 feet of
said Quarter -quarter.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Dean
Johnson Homes for a preliminary plat for Wynfield Place, subject to the following conditions:
1. Approval of the preliminary plat is contingent upon City approval of the rezoning of the site to
RMF -2 (Residential Multiple Family 2) and a site plan and vacation of West Medicine Lake
Drive.
2. This preliminary plat approves 56 townhouse lots, 13 single-family lots, and two common area
lots, in accordance with the plans received by the City on September 17, 2003, August 21,
2003 and July 17, 2003, except as amended by this Resolution.
3. As part of the final plat application, the applicant shall submit revised plans which reduce the
length of the private drives to no greater than 150 feet and provide a flat area behind the
single-family dwellings as specified in the Engineer's Memo.
4. As part of the final plat application, the applicant shall submit a revised landscaping plan in
compliance with the Zoning Ordinance which provides sod instead of seed around the
treatment ponds and in the area between the treatment pond and Northwest Boulevard.
5. As part of the final plat application, the applicant shall submit a lighting plan showing all
lighting proposed on the property in conformance with the Zoning Ordinance as well as the
location of all street lights in the public rights-of-way in conformance with the Subdivision
Ordinance.
6. As part of the final plat application, the applicant shall submit revised plans showing the 15 -
foot wetland buffer setback consistent with the Zoning Ordinance requirements.
7. As part of the final plat application, the applicant shall either modify the single-family model to
remove the deck off the rear of the home or reconfigure the unit lots to allow the deck to fit
on the lot.
8. As part of the final plat application, the applicant shall revise the tree preservation plan to
conform with the grading and drainage plan and comply with the Subdivision Ordinance. The
restitution/reforestation calculation shall also be revised and any additional inches required
shall be added to the landscaping plan.

9. As part of the final plat application, the applicant shall revise the plans showing a flat area on
47th Avenue North within 30 feet of the intersection with Northwest Boulevard as specified in
the Engineer's Memo.
10. As part of the final plat application, the applicant shall provide the City with copies of the
homeowner's association (HOA) documents for the neighborhood. The HOA documents
shall include language that prohibits decks or three -season porch conversions in violation of
City Ordinances and notes specifically which lots would not be allowed decks.
11. The HOA shall be responsible for maintenance of the private drives, sidewalks, boulevard
plantings, wetland buffers, mailboxes, monument signs and association common areas within
this development. The HOA documents shall include language to address maintenance of
these features.
12. As part of the final plat application, the applicant shall submit copies of the marketing
materials for the project, which must include the following information: 1) the lot and block
number of units which do not qualify for optional decks, porches or similar features; and 2)
Underwood Lane North will be extended when the adjacent property develops.
13. Prior to recording the final plat, the applicant shall submit the required utility and drainage
easements as approved by the City Engineer.
14. Prior to recording the final plat, the applicant shall submit a trail easement adjacent to
Northwest Boulevard across the entire property as specified in the Engineer's Memo.
15. Prior to recording the final plat, a pond maintenance agreement is required between the
developer and the City for the water quality ponds.
16. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to
City Code at the time the final plat is approved, for the total number of units shown on the
plans.
17. Prior to issuance of building permits, the applicant must install the required permanent
wetland buffer monuments pursuant to ordinance requirements.
18. Prior to the issuance of any building permits, the applicant shall install a sign which informs
future residents that Underwood Lane is a temporary cul-de-sac and that the road will
ultimately be extended to Schmidt Lake Road.
19. The applicant is encouraged to work with staff to make a portion of the development
accessible to first-time homebuyers.

20. Development standards shall be as required by the RMF -2 districts. No variances are granted
or implied.
21. No access to Northwest Boulevard shall be permitted.
22. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. Prior to recording the final plat, the applicant is eligible for one building permit per legal
parcel.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. Signs shall require separate permits prior to installation.
f. No building permits shall be issued until a contract has been awarded for sewer and water.
g. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
h. As part of the final plat application or issuance of any building or utility permits, the
applicant shall submit fire flow calculations in compliance with City Code and other
applicable codes.
i. As part of the final plat application materials, the applicant shall show the temporary
access road/water supply policy on the plans.
j. All structures shall be protected by a City approved automotive fire sprinkler system and
monitored as required.
k. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees per City Policy.
1. As part of the final plat application, the applicant shall revise plans as necessary to add and
relocate hydrants to approved locations; incorporate 45 -foot inside turning radius from all
directions on the private drives; identify the domestic size of the combination fire/domestic
water supply line; supply a PIV valve lockbox and siamese connection if required; and
show fire lane, address and directional signs in approved locations.
m. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
structures on sites adjacent to, or containing any open storm water drainage facility.
n. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started construction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 510 of City Code.
