RESOLUTION NO. 2003-454
AUTHORIZING THE VACATION OF PART OF A
DRAINAGE AND UTILITY EASEMENT WITHIN
LOT 5, BLOCK 1
WELLSWOOD COURT
WHEREAS, a petition was received to vacate part of a drainage and utility easement within Lot 5,
Block 1, Wellswood Court; and
WHEREAS, this request was made by the owner of the land abutting the area proposed to be
vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for October 14, 2003 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of October 14, 2003; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on October 14, 2003 to inform any and all
interested parties relevant to the vacation of part of a drainage and utility easement within Lot 5,
Block 1, Wellswood Court; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated:

To vacate that part of the utility and drainage easement over, under, and across Lot
5, Block 1, as donated and dedicated in the plat of WELLSWOOD COURT
Hennepin County, Minnesota described as follows: Commencing at the most
southerly corner of said Lot 5; thence North 42 degrees 06 minutes 11 seconds
West, assumed bearing, along the southwesterly line thereof 85.00 feet to the point
of beginning of the land to be herein described; thence North 35 degrees 55
minutes 39 seconds East 66.14 feet; thence North 13 degrees 33 minutes 00
seconds East 67.14 feet to a point on the northerly line of said Lot 5; thence South
03 degrees 44 minutes 24 seconds West 50.88 feet; thence South 22 degrees 02
minutes 29 seconds West 40.15 feet; thence South 49 degrees 32 minutes 00
seconds West 47.52 feet to the point of beginning and there terminating. Except
the southwesterly 10.00 feet and the northerly 10.00 feet of said Lot 5.
Adopted by the City Council on October 14, 2003.
