RESOLUTION 2003-435
APPROVING A CONDITIONAL USE PERMIT FOR QWEST TO ALLOW
INSTALLATION OF GROUND EQUIPMENT FOR HIGH-SPEED INTERNET
ACCESS AT 13315 58TH AVENUE NORTH. (2003104)
WHEREAS, Qwest has requested a conditional use permit to allow installation of ground
equipment in cabinets for high -speeds internet access on property legally described as
follows:
Lot 1, Block 2, Bass Lake Hills, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Qwest for a conditional use permit, subject to the following conditions:
1. A conditional use permit is approved to allow installation of ground equipment in
cabinets, as shown on the application and plans received by the City on September 11,
2003, based on the findings that the applicable general and measurable standards as
listed in the Zoning Ordinance have been met, except as may be amended by this
resolution.
2. The applicant shall plant shrubs in the quantity necessary to screen the cabinets from
the adjacent dwelling and the private drive. The shrubs planted shall be at least half
the height of the cabinets at planting and have an anticipated height at maturity of at
least five feet. The shrubs shall provide year-round screening.

3. Standard Conditions:
A. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
B. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
C. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started construction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
