HomeMy WebLinkAboutCity Council Resolution 2003-422CITY OF PLYMOUTH RESOLUTION 2003-422 APPROVING A PRELIMINARY PLAT AND FINAL PLAT FOR FAMILY HOPE SERVICES, FOR PROPERTY LOCATED AT THE SOUTHEAST CORNER OF COUNTY ROAD 101 AND 40TH AVENUE NORTH (2003003) WHEREAS, Family Hope Services has requested approval of a preliminary plat and final plat to allow a plat of two lots located south of County Road 101 and east of 40'h Avenue; and WHEREAS, the property is legally described as follows: The West 193.6 feet of the North 112.5 feet of the South 337.5 feet of the North half of the Northeast Quarter of the Southeast Quarter of Section 18, Township 118, Range 22, according to the United States Government Survey thereof, Hennepin County, Minnesota. That part of the North half of the Northeast quarter of Southeast quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at the Southwest corner of the North half of Northeast quarter of Southeast Quarter of Section 18, Township 118, Range 22; thence East on the South line of said North half of Northeast quarter of Southeast quarter of Section 18, Township 118, Range 22 distant 193.6 feet; thence North and parallel with the West line of said North half of Northeast quarter of Southeast quarter of said section distant 225 feet; thence West and parallel with the said South line distant 193.6 feet to said West line; thence South on said West line distant 225 feet to the place of beginning. Resolution 2003-422 (2003003) Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Family Hope Services for a preliminary plat and final plat for property located at the southeast corner of County Road 101 and 40th Avenue North, subject to the following conditions: 1. Approval of the plat is contingent upon City approval of the rezoning of property at 3950 County Road 101 from RMF -2 (Multiple Family 2) to P -I (Public/Institutional). 2. The preliminary plat is approved in accordance with the plat drawings received by the City on August 25, 2003, and approval of the final plat is approved in accordance with the plat drawings received by the City on September 9, 2003, except as may be amended by this Resolution. 3. Private driveway access shall be prohibited from County Road 101. 4. Prior to recording the final plat, drainage and utility easements shall be indicated on the final plat as follows: 1) for Lot 1, ten feet in width along the north and west lot lines, 20 feet in width along the east lot line, and 15 feet in width along the south lot line, and with the additional easement notched out in the southwest corner as shown on the drawing received on September 9, 2003; and 2) for Lot 2, ten feet in width along all lot lines. 5. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. c. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. d. This approval shall expire one year after the date of approval, unless the applicant has filed a complete application for a final plat; or, unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year per extension, as regulated under Section 510.01, Subd. 8 of the Subdivision Regulations.
