HomeMy WebLinkAboutCity Council Resolution 2003-407CITY OF PLYMOUTH RESOLUTION 2003-407— REVISING RESOLUTION 2002-181 APPROVING A SITE PLAN AND VARIANCES FOR ORRIN THOMPSON HOMES FOR A 201 -UNIT TOWNHOUSE DEVELOPMENT LOCATED NORTH AND WEST OF THE CANADIAN PACIFIC RAILROAD AND NORTH OF FUTURE SCHMIDT LAKE ROAD (2001114) WHEREAS, Orrin Thompson Homes has requested approval of a site plan and variances to allow construction of a 201 -unit townhouse development on property legally described as follows: That part of the southeast quarter of the northwest quarter of Section 8, Township 118 North, Range 22 west of the 5t` Principal Meridian, lying northwesterly of the northwesterly right-of-way line of the Soo Line Railroad. That part of the southwest quarter of the northeast quarter of Section 8, Township 118 North, Range 22 west of the 5t` Principal Meridian, lying northwesterly of the northwesterly right-of-way line of the Soo Line Railroad. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan and variances, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Orrin Thompson Homes for a site plan and variances for a 201 -unit townhouse development located north and west of the Canadian Pacific Railroad and north of future Schmidt Lake Road, subject to the following findings and conditions: 1. A site plan is approved to allow construction of a 201 -unit townhouse development, in accordance with the plans and application received by the City on March 14, 2002 and the landscape plan received on January 29, 2002, except as amended by this resolution. Approval of the site plan is contingent upon City approval of the rezoning of the site to RMF -2 (Residential Multiple Family 2), approval of a wetland replacement plan, and approval of the final plat. 3. Approval of a variance to the front -yard setback on Lot 3, Block 1 to allow a 20 foot front yard setback between the eight -foot at -grade patio and the public right-of-way, based upon the finding that the applicable variance standards as listed in Section 21030.03 of the Zoning Ordinance have been met. 4. Variances to fire lanes, structure distance from fire hydrants, and required turnarounds on private drives are approved in accordance with plans and application received by the City on March 14, 2002, except as amended by this resolution, based on the following conditions: a) All buildings must be protected y a City approved automatic fire sprinkler system. b) The fire hydrant water main system must be looped in an approved manner. c) Fire hydrants must be located in approved locations throughout the development. Approval of locations by the Fire Inspector is required. d) No parking of vehicles will be allowed on private drives or fire lanes. e) A City approved secondary access to the development form the north on Dunkirk Lane is required. The access must be unobstructed and accessible from the existing Dunkirk Lane to the development at all times. This may involve a cross easement agreement with the properties to the north of the development to ensure the unobstructed access at all times. 5. As part of the final plat application, the applicant shall submit the disclaimers (which shall also be reflected in the homeowner association documents) intended for potential homebuyers which address the following: a. The proximity of the Plymouth Gun Club, its hours of operation (which are subject to change) and that loud repetitive noise occurs during those hours, b. The proximity of the Canadian Pacific Railroad, the noise produced by the train traffic and its 24-hour nature, c. The temporary nature of the cul-de-sac on Dunkirk Lane and public road C. d. The extension of Schmidt Lake Road across the railroad tracks. e. The lot and block number of all units that do not qualify for the conversion of decks to three or four season porches due to the proximity of other units or setbacks. 6. As part of the final plat application, the applicant shall submit a lighting plan showing the location and style of all street lights and a lighting plan, including photometrics for all lighting proposed on private property. The streets lights shall be substantially similar to those used in Harvest Hills. Resolution 2003-407 Site Plan (2001114) Page 3 7. As part of the final plat application, the applicant shall submit a revised site plan which incorporates a fence along the non -wetland portion of the boundaries of the development and the 1) Plymouth Gun Club property and 2) the railroad property. 8. As part of the final plat application, the applicant shall submit a revised landscaping plan which incorporates additional screening east of the creek and north of Dunkirk Lane and also behind the units on Lots 132-138, Block 4. 9. As part of the final plat application, the applicant shall submit a plan illustrating the patios on Lot 3, Block 1 in conformance with the Zoning Ordinance. 10. As part of the final plat application, the applicant shall submit a plan illustrating the required distance between the structure and the private drive on Lot 55, Block 4 in conformance with the Zoning Ordinance. 11. As part of the final plat application, the applicant shall submit revised plans showing the structures on Lots 89 and 90, Block 4 with the required 25 foot side -yard setback as specified in the Zoning Ordinance. 12. As part of the final plat application, the applicant shall submit revised plans illustrating all the driveways in the development a minimum of 40 feet from the intersection of any two street rights-of-way in conformance with the Zoning Ordinance. 13. As part of the final plat application, the applicant shall provide the City with copies of the homeowner's association (HOA) documents for the neighborhood. 14. The HOA shall be responsible for maintenance of sidewalks, boulevard plantings, wetland buffers, mailboxes, monument signs and association common areas within this development. The HOA documents shall include language to address maintenance of these features. 15. Prior to recording the final plat, the applicant shall submit the required utility and drainage easements as approved by the City Engineer. 16. Prior to recording the final plat, a pond maintenance agreement is required between the developer and the City for the water quality pond. 17. Prior to recording the final plat, the applicant shall submit the required easements for the trail along Schmidt Lake Road and Dunkirk Lane. 18. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to the Dedication Policy in effect at the time of recording the final plat, for the total number of units shown on the plans. Resolution 2003-407 Site Plan (2001114) Page 4 19. Prior to the issuance of any building permits, signs shall be posted in the following locations notifying residents of the following items: a. Located on the end of public road C on or near the Gun Club property advising potential property owners of the existence of the gun club, its hours of operation (which are subject to change), and that repetitive, loud noise is produced during those hours. This sign shall remain in place as long as the Gun Club is in operation. b. At the farthest finished extent of Dunkirk Lane alerting residents to the temporary nature of the cul-de-sac. 20. Prior to the issuance of any building permits, the applicant shall submit plans showing the additional building materials and how they reduce the impact of the Gun Club and the Railroad on the adjacent units. sr7-n�s,�,�,�--a�.Yg-n-;,x .coax--�o�=�� ` 1�^+ Formatted: Bullets and Numbering 2221. The applicant shall construct a paved secondary access road constructed to City standards-- - - Formatted: Bullets and Numbering from the existing Dunkirk Lane to public road F as shown on the site plans. 23-22. The applicant is encouraged to incorporate additional sidewalks along the public streets-- - - Formatted: Bullets and Numbering leading to Dunkirk Lane. 24-.23. The applicant in encouraged to work with staff to meet the gap financing of qualified-- - - Formatted: Bullets and Numbering buyers for the affordable units. 224. All construction traffic shall enter the site from Schmidt Lake Road. No access shall be-- - - Formatted: Bullets and Numbering permitted via the existing unpaved, Dunkirk Lane. 225. Development standards shall be as required by the RMF -2 district. No variances are-- - ------------------------------- - Formatted: Bullets and Numbering granted or implied except those specifically noted in this resolution. 27-26. The applicant shall be responsible for constructing the trail along Schmidt Lake Road and-- - - Formatted: Bullets and Numbering Dunkirk Lane for the entire project. Financial guarantees for the completion of this item shall be included in the development contract. 25-27. Standard Conditions: +- - - Formatted: Bullets and Numbering a. Compliance with the City Engineer's Memorandum. b. Prior to the issuance of a building permit, the applicant shall submit of the required Financial Guarantee and Site Performance agreement for completion of site improvements within twelve months of the date of this Resolution. c. With the exception of one building permit for a model home, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance. h. As part of the final plat application, submission of fire flow calculations in compliance with City Code and other applicable codes. i. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Policy. j. As part of the final plat application, the applicant shall revise plans as necessary to add and relocate hydrants to approved locations, identify the domestic size of the combination fire/domestic water supply line, supply a PIV valve and siamese connection if required, and show fire lane, address and directional signs in approved locations.
