RESOLUTION 2003-390
APPROVING ENCROACHMENT AGREEMENT FOR
RETAINING WALL CONSTRUCTION AT
16605-43 RD AVENUE NORTH
WHEREAS, John and Wanda Cahill have requested approval to execute an encroachment
agreement to construct a retaining wall within a drainage and utility easement; and;
WHEREAS, the encroachment agreement only permits the encroachment and the retaining wall and
all related facilities must still meet all applicable City codes including the building code and zoning
code; and
WHEREAS, the property is legally described as Lot 21, Block 15 Westbranch Addition;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the construction of a
retaining wall located within a drainage and utility easement along the east side of the property
located at 16605 43rd Ave. N.
