FRENCH REGIONAL PARK LOCATED SOUTH OF ROCKFORD ROAD AND EAST OF NORTHWEST BOULEVARD (2003092) WHEREAS, Three Rivers Park District has requested an interim use permit for property located south of Rockford Road and East of Northwest Boulevard, legally described as follows: Parcel A — 15-118-22-41-0003 That part of the northeast quarter of the southeast quarter of section 15, Township 118, Range 22, described as follows: beginning at the intersection of the east line of the northeast quarter of the southeast quarter of said section 15 with the survey line of County Road 9 thence westerly along said survey line to its intersection with the north line of said northeast quarter of the southeast quarter, thence west along said north line to its intersection with the center line of country road 61 thence southerly along said center line to its intersection with the south line of said northeast quarter of the southeast quarter thence east to the southeast corner thereof thence north to the beginning, subject to roads. Parcel B — 15-118-22-14-0005 That part of the southeast quarter of the northeast quarter and the northeast quarter of the southeast quarter, all in S 15, T 118, Range 22 lying northerly of the line designated survey line of the plat of Hennepin County SAH No. 9, Plat 9, southeasterly of the following described line: Beginning at a point on the east line of said southeast quarter of the northeast quarter 374.13 feet northerly from the southeast corner of said southeast quarter of the northeast quarter; thence S 60 degrees 19 minutes 41 seconds west (assume the east line of said southeast quarter of the northeast quarter to have a bearing north 0 degrees, 18 minutes. 05 second east) to said designated survey line on the plat of Hennepin County SAH No. 9, Plat 9; and there terminating; Except that part of said southeast quarter of the northeast quarter and of said northeast quarter of the southeast corner described as follows: Beginning at the southeast corner of said southeast quarter of the northeast quarter; thence north along the east line of said southeast quarter of the northeast quarter a distance of 134.12 feet; thence west, deflecting 90 degrees, 55 minutes 20 Resolution 2003-381 (2003 092) Page 2 seconds to the left a distance of 215.3 feet; thence south, parallel with the east line of said southeast quarter of the northeast quarter and its extension, to the line designated survey line on the plat of Hennepin County SAH No. 9, Plat 9; thence easterly along said survey line to the east line of said northeast quarter of the southeast quarter; thence north along said east line to the point of beginning. The north line of said southeast quarter of the northeast quarter is marked by judicial landmarks set pursuant to Torrens Case No. 11678. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Three Rivers Park District for an interim use permit to allow wetland mitigation work on property located south of Rockford Road and east of Northwest Boulevard, subject to the following findings and conditions: 1. This interim use permit is approved to allow the restoration of a wetland and construction of a berm, in accordance with the application and plans received by the City on August 13, 2003, based on the findings that the applicable general and measurable standards as listed in the Zoning Ordinance have been met, except as amended in this resolution. 2. The applicant shall complete all grading and site restoration by October 31, 2003. 3. All disturbed and reclaimed areas shall be seeded/restored in compliance with the Zoning Ordinance and with the approved wetland mitigation plan. The bermed area is permitted to be seeded as indicated on the plans. 4. Prior to issuance of a grading permit, the applicant shall obtain approval of the Bassett Creek Watershed and submit proof of such approval with the grading permit application. 5. Prior to issuance of a grading permit, the applicant shall revise the plans to show erosion control fencing throughout the site in compliance with the Zoning Ordinance and City Code. 6. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 7. The applicant shall comply with the Noise Ordinance, and the hours of operation shall be between the hours of 7 am to 7 pm, Monday through Friday and 8 am to 6 pm on Saturday.
