HomeMy WebLinkAboutCity Council Resolution 2003-380CITY OF PLYMOUTH RESOLUTION 2003-380 APPROVING CONDITIONAL USE PERMIT FOR SENTINEL PROPERTY MANAGEMENT FOR PROPERTY LOCATED AT 2600 FERNBROOK LANE NORTH (2003086) WHEREAS, Sentinel Property Management has requested approval of a conditional use permit to allow 60 percent office use in the I-2 (General Industrial) Zoning District located on property legally described as follows: Parcel 1: Lot 4, Block 1, INDUSTRIAL PARK 494, according to the recorded plat thereof, Hennepin County, Minnesota. Parcel 2: That part of Lot 5, Block 1, INDUSTRIAL PARK 494, described as beginning at the Southwest corner of said Lot 5; thence on an assumed bearing of North 89 degrees 55 minute 00 seconds East, along the South line of said Lot 5 to a point 57.84 feet Westerly from the Southeast corner of said Lot 5; thence North 40 degrees 57 minutes 53 seconds West 68.75 feet; thence North 49 degrees 00 minutes 54 seconds West 47.70 feet; thence North 19 degrees 38 minutes 45 seconds West 48.16 feet; thence North 02 degrees 16 minutes 59 seconds West 29.64 feet; thence North 18 degrees 05 minutes 36 seconds West 38.26 feet; thence North 01 degrees 27 minutes 48 seconds West 35.70 feet; thence North 39 degrees 36 minutes 54 seconds East 39.37 feet; thence North 84 degrees 32 minutes 33 seconds East 39.70 feet; thence South 53 degrees 23 minutes 05 seconds East 68.62 feet; thence South 78 degrees 59 minutes 54 seconds East to the East line of said Lot 5; thence Northerly along said East line to the Northeast corner of said Lot 5; thence Westerly along the North line of said Lot 5 to the Northwest corner of said Lot 5; thence Southerly along the West line of said Lot 5 to the point of beginning, according to the recorded plat thereof, Hennepin County, Minnesota. Together with the Declaration of Covenants and Restrictions and Easements dated and recorded August 30, 1991, County Recorder Document Number 5820352 benefiting the property to be registered with conditions and restrictions on neighboring property and providing for a retaining wall easement. Resolution 2003-380 (2003086) Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Sentinel Property Management for a conditional use permit to allow 60 percent office use in the industrially -zoned building located at 2600 Fernbrook Lane North, subject to the following conditions: 1. The conditional use permit allows up to 33,177 square feet (60 percent) for office use at the 55,295 square -foot building located at 2600 Fernbrook Lane North, in accordance with the application and plans received by the City on July 25, 2003, except as amended by this resolution. 2. The conditional use permit is approved with the finding that all applicable conditional use permit standards are met, as follows: a. the proposed use at this location would comply with the Comprehensive Plan; b. the proposed use would not be detrimental to, or endanger the public health, safety, morals, or comfort; c. the proposed use would not be injurious to the surrounding properties or to the City as a whole; d. the proposed use would not impede the orderly development of the district; e. the site is adequately served by public facilities; f. the use would comply with the regulations of the I-2 zoning district; and the use would not alter the previously approved site plan and adequate parking would be available to serve the proposed use. 3. The appropriate building permits must be obtained by the applicant prior to construction of the office space within this building. 4. Standard Conditions: a. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
