HomeMy WebLinkAboutCity Council Resolution 2003-366CITY OF PLYMOUTH RESOLUTION 2003-366 APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCES FOR A 4,400 SQUARE FOOT COMMERCIAL BUILDING ON PROPERTY LOCATED AT 3410 KILMER LANE NORTH (2003074) WHEREAS, Archnet has requested approval of a site plan, conditional use permit, and variances for property legally described as follows; Lot 8, Block 2 Glen Erie Addition, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Archnet for a site plan, conditional use permit and variances subject to the following conditions: 1. A site plan is approved for an approximately 4,400 -square foot commercial building, according to the plans and application received by the City on August 11, 2003, except as amended by this resolution. 2. A conditional use permit to allow up to 40 percent of the gross building floor area for warehousing/indoor storage is approved, based on the finding that the applicable conditional use standards as listed in Section 21015.02 of the Zoning Ordinance and the measurable performance standards listed in Section 21550.07 of the Zoning Ordinance have been met, including the requirements that the warehousing/indoor storage be accessory to a permitted use, no outdoor storage is permitted, and the area dedicated to warehousing/indoor storage area is limited to 40 percent of the gross floor area. Variances to 1) the C-5 district's minimum lot area of one acre and 2) the requirements that no loading area be closer than 300 feet from residentially zoned properties are approved based upon the finding that the applicable variance standards as listed in Section 21030.03 of the Zoning Ordinance have been met. 4. A variance to the requirement for a fire lane is approved, except as amended by this resolution, based on the following conditions: a. Fire hydrants be installed in approved locations on the site. b. Fire flow calculations be submitted to the Fire Inspector for approval. c. The building must be protected by a City approved fire sprinkler system. d. City approved standpipes or an automatic fire alarm system must be installed in approved locations within the building. A determination of the fire alarm system or standpipe installation will be made by the Fire Inspector based on the building plan submittal for building permits. 5. Any trucks loaded on-site shall be loaded inside the building. 6. Prior to the issuance of a building permit, the applicant shall revise the plans to reflect parking and drive aisles in conformance with the requirements of the Zoning Ordinance. 7. Prior to the issuance of a building permit, the applicant shall revise the lighting plan to show compliance with the requirements of the Zoning Ordinance. 8. Prior to the issuance of a building permit, the applicant shall revise the landscaping plan to demonstrate that sod will be installed and that the size of the required trees is in conformance with the Zoning Ordinance. 9. Signage for this site shall be in compliance with the Sign Ordinance. Separate sign permits shall be required. 10. Trash storage shall be in compliance with the Zoning Ordinance. 11. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with the Ordinance regarding the location of post indicator valve, fire department connection and lockbox, water mains, site hydrants and fire lane signage. d. Prior to the issuance of any permits, the applicant shall submit fire flow calculations flowing the remote two hydrants and the sprinkler system design simultaneously in compliance with City Code and identify the size of the solenoid device and the location street hydrants on the plans. e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. Resolution No. 2003 -3 66 2003074 Page 3 f. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the dedication policy in effect at the time of building permit issuance. g. No building permits shall be issued until the Site Improvement Performance Agreement and has been executed and the required financial guarantees submitted. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06 and 21045.09 of the Zoning Ordinance.
