RESOLUTION 2003-365
APPROVING CONDITIONAL USE PERMIT TO ALLOW RELOCATION OF A
HOUSE FROM 4850 MEDICINE LAKE DRIVE W. TO 4745 MEDICINE LAKE
DRIVE W. (2003080)
WHEREAS, Randy and Lanet Johnson have requested a conditional use permit to allow
relocation of a house from 4850 Medicine Lake Drive W. to 4745 Medicine Lake Drive
W. onto property legally described as follows:
Commencing at a point in South line of the North 26 acres of South 33 acres of
Northwest quarter of Southeast quarter Section 10 Township 118 Range 22 Distance
140.4 feet West from Southeast corner thereof said point being the center line of town
road; thence west 300 feet along said South line; thence North at right angles 187.8 feet to
center line of said road; thence southeasterly to beginning, except road.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Randy and Lanet Johnson, subject to the following conditions:
1. A conditional use permit is approved to allow relocation of a house from 4850
Medicine Lake Drive W. to 4745 Medicine Lake Drive W., as shown on the
application and plans received on July 10, 2003 and revisions received on July 21,
2003 and July 23, 2003.
2. Prior to issuance of a building permit, revise the survey for 4745 Medicine Lake Drive
W., to show that the existing house, garage, and driveway are to be removed.

3. Prior to issuance of a building permit, the survey shall be revised to show the
following changes: The driveway shall have a) a maximum curb -cut of 24 feet, b)
intersect the roadway at an 90° angle, and c) match the proposed profile for Medicine
Lake Drive W.
4. Prior to issuance of a building permit, the applicant shall provide a financial guarantee
and Site Improvement Performance Agreement, as specified in Section 21015.08.
5. Prior to the issuance of a building and moving permit for 4745 Medicine Lake Drive
W., the following are required:
A. The survey shall be revised to show the location and removal of the existing septic
system.
B. The survey shall be revised to show proposed contour lines. Provide additional
detail on the proposed retaining walls, including top and bottom of wall elevations.
C. A Building Demolition Permit is required. Provide a demolition plan showing the
removal of all structures and driveway. The foundation wall, basement floor and
all other building component materials shall be properly disposed of and may not
be used as buried fill. Verification must be provided that any existing well(s) on
the property have been sealed and grouted by a licensed well contractor and that a
septic system abandonment permit has been obtained from Hennepin County.
6. For the property at 4850 Medicine Lake Drive, the following items are required:
A. A Building Demolition Permit is required. Provide a demolition plan showing the
removal of all structures and driveway. The foundation wall, basement floor and
all other building component materials shall be properly disposed of and may not
be used as buried fill. Verification must be provided that any existing well(s) on
the property have been sealed and grouted by a licensed well contractor and that a
septic system abandonment permit has been obtained from Hennepin County.
B. The property shall be regraded to the original contour.
7. All required work associated with the property at 4850 Medicine Lake Drive W. must
be satisfied and approved prior to building final inspection approval for the property at
4745 Medicine Lake Drive W.
8. At the time of building permit issuance, a new address and street name will be assigned
in keeping with the street naming policy. Address numerals shall be visible from the
roadway and shall also be located on the mailbox.

9. The relocated structure shall comply with the applicable requirements of the
Minnesota State Building Code and shall be ready for occupancy within six (6) months
from the date of location on the site.
10. Standard Conditions:
A. Compliance with the City Engineer's Memorandum.
B. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
C. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
D. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started construction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
