RESOLUTION NO. 2003-352
AUTHORIZING THE VACATION OF PART OF A PERPETUAL EASEMENT FOR
STREET PURPOSES
PARCEL NO. 15-118-22-32-0003
WHEREAS, a petition was received to vacate part of a perpetual easement for street purposes in Parcel
No. 15-118-22-32-0003; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for August 12, 2003 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of August 12, 2003; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on August 12, 2003 to inform any and all interested
parties relevant to the vacation of part of a perpetual easement for street purposes in Parcel No. 15-
118-22-32-0003; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following part of a perpetual easement for street purposes be
vacated:
DESCRIPTION OF PARCEL
LEGAL DESCRIPTION OF PARCEL: The East 130 feet of the West 805 feet of the North
330 feet of Northwest Quarter of the Southwest Quarter of Section 15, Township 118, Range
22, except Road, Hennepin County, Minnesota.
DESCRIPTION OF PART OF EASEMENT TO BE VACATED:
The south 10.5 feet of the north 60 feet of the east 130 feet of the west 805 feet of the north 330
feet of Northwest 1/4 of the Southwest Quarter of Section 15, Township 118, Range 22, except
Road, Hennepin County, Minnesota of the above described City property. Recorded under
Document Number 3980157
FURTHER, a drainage and utility easement shall be retained over all of the vacated perpetual easement
for street purposes.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
