HomeMy WebLinkAboutCity Council Resolution 2003-338CITY OF PLYMOUTH RESOLUTION 2003-338 APPROVING SITE PLAN AND VARIANCE FOR THE CITY OF PLYMOUTH TO ALLOW CONSTRUCTION OF A PUMP HOUSE AT 4450 NATHAN LANE NORTH (2003 067) WHEREAS, the City of Plymouth has requested approval of a site plan and setback variance to allow construction of pump house and related water well on property located at 4450 Nathan Lane North; and, WHEREAS, the property is legally described as follows: Outlot A, Rockford Square, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the site plan and variance to allow construction of a pump house and related water well on property located at 4450 Nathan Lane, subject to the following conditions: 1. This resolution approves the construction of a pump house and related water well, in accordance with the application and plans received by the City on June 13, 2003, except as may be amended by this resolution. 2. This resolution approves a setback variance of 34 feet to the west lot line, based upon the following findings: a. Due to the wetland (Storm Pond NB -P4), the site is left with a shallow lot depth of roughly 95 feet for the construction of the pump house. The requested variance would allow building placement that would provide a reasonable use of Resolution 2003-338 (2003 067) Page 2 the land, while providing a manageable slope down to the wetland elevation. Requiring the pump house and well to be setback 50 feet from the west lot line would require importing fill and installing a much larger retaining wall in order to provide a buildable area and match grade with the wetland elevation. b. The specific conditions related to this parcel are somewhat unusual and not applicable to most other properties in this area. c. The request is not based upon a desire to increase the value or income potential of the property but rather to allow construction of a pump house and well to improve the municipal water supply. d. The site conditions relating to the need for the variance were not created by the landowner. e. Granting the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The pump house would be constructed with brick and would be compatible with the character of the surrounding development. f. The granting of the variance would not impair an adequate supply of light or air to adjacent properties, nor would it substantially increase congestion in the public streets, increase the danger of fire, endanger the public safety, or substantially diminish or impair property values within the neighborhood. g. The requested variance is the minimum action required to eliminate the hardship. 3. The appropriate building permits must be obtained prior to construction of the structure. 4. Prior to issuance of building permits, a lighting plan shall be submitted indicating compliance with the City's lighting regulations. 5. This approval shall expire one year after the date of approval, unless the property owner or applicant has commenced the use, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21030.06 of the Zoning Ordinance.
