HomeMy WebLinkAboutCity Council Resolution 2003-335CITY OF PLYMOUTH RESOLUTION 2003-335 APPROVING REQUEST FOR A CONDITIONAL USE PERMIT AND SITE PLAN AMENDMENT FOR C AND K AUTOMOTIVE TO ALLOW A MINOR AUTO REPAIR BUSINESS IN THE C-3 (HIGHWAY COMMERCIAL) ZONING DISTICT FOR PROPERTY LOCATED AT 3510 KILMER LANE NORTH. (2003057) WHEREAS, C and K Automotive has requested a conditional use permit and site plan amendment to allow a minor auto repair business in the C-3 (Highway Commerical) District for property located legally described as follows: Lots 12 and 13, Block 6, Glen Erie Addition, Hennepin County, Minnesota, except road. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by C and K Automotive for a conditional use permit and site plan amendment, subject to the following conditions: 1. A conditional use permit and site plan amendment are approved to allow a minor auto repair business in the C-3 (Highway Commerical) District, as shown on the application and plans received on May 29, 2003 and July 7, 2003, except as may be amended by this resolution. 2. A building permit is required prior to the commencement of the use. 3. Prior to issuance of a certificate of occupancy, the applicant shall remove the roof sign and support structure currently located on the car wash building. Resolution 2003-335 (2003057) Page 2 4. Prior to issuance of a certificate of occupancy, the applicant shall restripe the parking lot consistent with the approved site plan stamped as received July 7, 2003. 5. Outdoor storage of tow trucks is permitted in the screened portion of the property only. 6. Any locking system on the gates shall be configured in such a way to allow the fire department 24-hour access to the property. 7. All trash receptacles shall be stored within the building or within an enclosure that meets the requirements of Section 21120.08 of the Zoning Ordinance. 8. There shall be no outdoor service operation of lubrication equipment, hydraulic lifts or service pits, tire changing, drive systems repair and turning, or similar operations. 9. No outside storage of parts, equipment or inoperable vehicles shall be allowed. 10. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. An automatic fire extinguishing system may be required with a change in the use of the structure. Should a system be required, a PIV and Fire Department connection are also required in approved locations. D. Fire lane signs are required in approved locations. E. Prior to issuance of a certificate of occupancy, address signage in compliance with the Fire Code shall be required on both principal buildings. F. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07, 21030.06 and 21045.09 of the Zoning Ordinance.
