RESOLUTION NO. 2003 - 326
AUTHORIZING THE VACATION OF PART OF A
DRAINAGE AND UTILITY EASEMENT WITHIN
LOT 11, BLOCK 3
TIMBER CREEK CROSSING
WHEREAS, a petition was received to vacate part of a drainage and utility easement within Lot 11,
Block 3, Timber Creek Crossing; and
WHEREAS, said petition was signed by a majority of the owners of the land abutting the area
proposed to be vacated; and
WHEREAS, a public hearing with respect to said vacation was scheduled for July 22, 2003 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of July 22, 2003; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on July 22, 2002 to inform any and all interested
parties relevant to the vacation of part of a drainage and utility easement within Lot 11, Block 3,
Timber Creek Crossing; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated:
That part of the drainage and utility easement as dedicated on the record plat of Timber
Creek Crossing, which lies within Lot 11, Block 3 in said plat lying southerly of the
northerly 7.50 feet of said Lot 11 and lying westerly of the easterly 13.85 feet of said
Lot 11.
Adopted by the City Council on July 22, 2003.
