HomeMy WebLinkAboutCity Council Resolution 2003-325CITY OF PLYMOUTH RESOLUTION NO. 2003-325 AUTHORIZING THE VACATION OF PART OF 34TH AVENUE RIGHT-OF-WAY IN PLYMOUTH FREEWAY CENTER 2ND ADDITION, PLYMOUTH BUSINESS CENTER 5TH ADDITION, AND ELWELL MILEY QUINN ADDITION WHEREAS, a petition was received to vacate part of 34th Avenue North in Plymouth Freeway Center 2nd Addition, Plymouth Business Center 5th Addition, and Elwell Miley Quinn Addition; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for July 22, 2003 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 22, 2003; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on July 22, 2003 to inform any and all interested parties relevant to the vacation of a part of 34th Avenue North in Plymouth Freeway Center 2nd Addition, Plymouth Business Center 5th Addition, and Elwell Miley Quinn Addition; and WHEREAS, it was determined by the City Council that said right-of-way is not needed for public purposes; and Resolution No. 2003-325 Page 2 WHEREAS, St. Paul Companies, Inc. will convey a portion of the vacated right-of-way to the owner of Elwell, Miley, and Quinn Addition Outlot A to provide access to 34th Avenue and Annapolis Lane; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following street right-of-way be vacated: Those parts of Annapolis Lane North and 34th Avenue North as dedicated in the plats of Plymouth Freeway Center 2nd Addition, Plymouth Business Center 5th Addition and Elwell Miley and Quinn Addition, Hennepin County, Minnesota, lying southeasterly of a curve, concave to the northwest, which lies 70.00 feet southeasterly of, and is concentric with the tangential curve at the southeast corner of Lot 2, Block 2, said Plymouth Business Center 5th Addition. Adopted by the City Council on July 22, 2003. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
