HomeMy WebLinkAboutCity Council Resolution 2003-324CITY OF PLYMOUTH RESOLUTION 2003 - 324 APPROVING CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION OF AN AREA IDENTIFICATION SIGN IN THE PUBLIC RIGHT-OF-WAY LOCATED AT THE INTERSECTION OF OLD ROCKFORD ROAD AND ROCKFORD ROAD (COUNTY ROAD 9). (2003055) WHEREAS, the Quail Ridge Homeowners Association and the City of Plymouth have requested a conditional use permit to allow construction of an area identification sign in the public right-of-way described as follows: Within the Old Rockford Road right-of-way north of the Rockford Road (County Road 9) right-of-way and adjacent to Lots 3 and 4, Block 4 Quail Ridge of Plymouth, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by the Quail Ridge Homeowner's Association and the City of Plymouth for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow construction of a six-foot by 3'/4 -foot area identification sign in the public right-of-way, as shown on the application and plans received on May 27, 2003 and amended on July 16, 2003, except as may be amended by this resolution. 2. Approval of the conditional use permit is contingent on the approval of an encroachment agreement for the maintenance of the public right-of-way, sign and formal landscaped area. Resolution 2003-324 (2003055) Page 2 3. A sign permit is required prior to installation. 4. With the exception to the regulation pertaining to setback from the public right-of- way, the sign shall comply with Section 21155 of the Zoning Ordinance. 5. The sign and landscaped area shall beset back 10 feet from the trail at a minimum. 6. The sign shall be set back at a minimum as follows: 1) 5 feet west from the extension of the property line between Lots 3 and 4, Block 4, Quail Ridge subdivision, and 1) 8 feet from any utility line. 7. The landscaped area shall be no larger than specified in the encroachment agreement. 8. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
