Chairman Mike Stulberg, Commissioners Virginia Black, Linda Qja, Christian Preus, Saundra Spigner (arrived at 7:10 p.m.), and Barb Stimson MEMBERS ABSENT: Commissioner Allen Ribbe STAFF PRESENT: Community Development Director Anne Hurlbuct, Planning Supervisor Barbara Senness, Senior Planner John Keho, and Planner Shawn Drill 1. Call to Order: The meeting was called to order at 7:05 p.m. 2. Public Forum: None. 3. Approval of Agenda: Approved unanimously. 4. Aporoval4f Minutesi MOTION by Commissioner Preus, seconded by CommissionerlQja, to approve the minutes of the October 11,'1995, Planning Commission without modification. VOTE. 5 Ayes. MOTION CARRIED, MOTION by Commissioner Black, seconded by Commissioner Preus, to approve the minutes of the October 25, 1995, Planning Commission without modification, VOTE. 4 Ayes, MOTION CARRIED. (Commissioner Oja abstained) 5, NEW BUSINESS: A. Reschedule December 27 Plannin4 The Planning Commission instructed staff to reschedule the December 27, 1995 Planning Commission meeting to December 20, 1995, Planning Commission Minutes November 28, 1995 Page 224 0 5. OLD BUSINESS A. City of Plymouth (95100) - Workshop on Proposed Zoning Ordinance Amendments Planning Supervisor Senness presented the proposed zoning ordinance amendments for the Administrative Sections. She noted that the proposed revisions include elimination of the Board of Zoning Appeals (BOZA), and that the City Council would fill that function. Community Development Director Hurlburt stated that, due to the minor variance process that was initiated a feet years ago, the case load for the BOZA is down substantially. This was one of the primary reasons for considering whether the City Council should take on this role in the future. She also stated that having the Planning Commission conduct the public hearings would help the staff to manage the processing of applications. Planning Supervisor Senness introduced Mr.. David Licht,, President of Northwest Associated Consultants, head consultant on this project, Mr. Licht noted that one of the goals of the new Zoning Ordinance was to consolidate as much as possible, and to reduce the amount of duplication and incompatibility. r Mr. Licht reviewed the proposed revisions to the Administrative Sections, withthe following discussion: 21000,10 --Uses Not Provided for within 'Zoning Districts. This is an all new section, and one which is critical for the Ordinance. 21005 -- Definitions Section, Not completed yet, this will be very extensive, 21010 -- Amendments Section. Some changes here to clarify that the Council has the option to hold a public hearing,, if deemed necessary. Also, new text to outlining referral of items back to the Planning Commission. It was noted that zoning text and map amendments are the only action that will require a super -majority vote. 21015 _- Conditional Use Permits. Same ,general format as current provisions. Daycare facilities dropped from 1;320 to 500 feet for mailed notice requirement. New general performance criteria added to provide a more consistent evaluation procedure, therefore, more equal treatment to applicants. 0 Planning Commission Minutes November 28, 1995 Page 225 The proposed provisions relating to revocation of CUP's was discussed is detail. Mrs Licht noted that revocation would require a public hearing. Findings would be required to demonstrate violation of the terms. 21020 — Interim Uses. This is an all new section to allow uses (such as excavation) to be allowed for a specific time period. This section would allow property owners to maintain viability of their land on an interim basis. This has been an effective tool when uses are proposed that are acceptable for the short tern, but not acceptable over the long term. 21025 -- Administrative Permits. This section is somewhat unique to Plymouth and has worked exceptionally well to expedite requests while maintaining a high degree of standards, The proposed language provides a system of check and balances. Senior Planner Keho provided an explanation of instances when an administrative permit may be issued, including special events, grand openings, and sidewalk sales, 21030 -- Variances. Mr. Licht noted that the major change is that the City Council would act as the Board of Zoning Adjustments and Appeals, He noted that the proposal continues to allow the Zoning Administrator to approve minor variances, Persons aggrieved by the decision of the Board would have the right to seek the review of a decision through the proper court system. 21035 -- Appeals. This is now its own section. It provides a means to appeal the question of interpretation of the Zoning Ordinance. 21040 --Environmental Review. This is an all new section, It has already been reviewed by the Environmental Quality Board (EQB). This is a positive addition to the Ordinance that will signal the process to applicants. Chairman Stulberg asked :staff to present a workshop on Environmental Assessment Worksheets (EAW's) and Environment Impact Statements EIS's) sometime in the future, if there is a slowdown in new applications. 21045 -- Site Plan Review. The sketch plan section is new. Review of sketch plans is advisory only, The Zoning Administrator would continue to have ability to approve minor projects.. A critical part of this section is the provision relating to Site Improvement Performance Agreements (SIPA's), Newer ordinance requirements such as Wetlands, water quality ponds, and reforestation have been added into the list of items that are covered by the financial guarantee. Planning Supervisor Senness stated that the draft for the City Center section will be the next review item. Staff will also begin looking at where the new commercial and industrial zoning districts may work throughout the City, In ,response to questions raised by Chairman Stulberg, Community Development Director Hurlburt stated that the Zoning Revisions would be presented to the City Council at an informational meeting prior to the Public Hearing. 1 7. ADJOURNMENT MOTION by Commissioner Spigner, seconded by Commissioner Stimpson to adjourn. MOTION CARRIED UNANIMOUSLY. Chairman Stulberg declared the meeting, adjourned at 9:15 p,m.
