PLANNING COMMISSION MINUTES
TONE 9, 1993
MEMBERS PRESENT: Chairman Mike Stulberg, Commissioners Pd Albro, Scott
Syverson, Barb Stimson, Julie Witt, Mike Wigley, and
Dennis Zylla.
MEMBERS ABSENT. None.
STAFF PRESENT: Acting Director Joe Ryan, City Engineer Dan Faulkner,
Associate Planner John Keho, and Planning Secretary
Jackie Watson.

MOTION by Commissioner Zy)la, seconded by Commissioner Stimson to approve theMay19, 1993 Planning Commission Minutes.

CONSMW AGENDA:
METROPOLITAN LIFE (91.071)
MOTION by Commissioner Zylla, seconded by Commissioner Stimson to recommend
approval of the request by Metropolitan Life for an Amendment to the Landscaping
Plan to reduce the number of plantings adjacent to a proposed parking lot at 15700
Rockford Road, subject to all conditions listed in the May 27, 1993 staff report.
Vote. 7 Ayes. Motion carried.
RODD AND JEAN JOHNSON (93040)
Chairman Stulberg introduced the request by Rodd and Jean Johnson for an Amended
PUD Plan and Conditional Use Permit for a;3rd garage stall at 14835 -41st Avenue
North.
Chairman Stulberg waived the review of the May 17, 1993 staff report.
Chairman Stulberg opened and closed the Public Hearing as there Was no one present tospeakontheissue.

MOTION by Commissioner Wigley, seconded by Commissioner Zylla, to recommend
approval of the request by Rodd and Jean Johnson for an Amended PUD Plan and
Conditional Use Permit for a 3rd garage stall at 14835 -41st Avenue North, subject to
all conditions listed in the May 17, 1993 staff raport.
Roll Can Vote. 7 Ayes. Motion carried on a unanimous vote.
JAMES LEONHARDT (93041)
Chairman Stulberg introduced the request by James Leonhardt for a Conditional Use
Permit for a Home Occupation to operate a printing equipment and machinery repaircompany, at 9620 -28th Avenue North.
Associate Planner John Keho reviewed the May 17, 1993 staff report.
Commissioner Zylla asked what type of vehicle made deliveries to the home.
Associate Planner Keho stated that he thought it was a UPS vehicle.
The petitioner, W. sLeonhardt was not present.
Chairman Stulberg opened the Public Hearing.
Chairman Stulberg introduced Ms. Donna Leonhardt, of 9640 28th Avenue North
Ms. Leonhardt stated that she lived adiacent to the site and said that there is dangerous
equipment in the garage. She said she is concerned about the danger to the children in
the area from the delivery trucks and the possibility of children going into the garage.
She said that Mr. Leonhardt uses the garage for this business and parks his vehicles in
the driveway.
Commissioner Wigley asked Ms, Lconhardt if she Was related to the petitioner.
Ms. Leonbardt stated that she was married to the pefit oner 10 years ago.

Wigley stated that this seemed to be an industrial business and should be'located awayfromtheresidentialma,

GOFF HOMES (93008)
Chairman Stulberg introduced the request by Goff Homes for a RPUD Preliminary
PhuVPlat and Conditional Use Permit for 60 single family attached units; and,
Rezoning of the property from FRD to R4, located west of Xenium Lane. at 36th
Avenue North.
Associate Planner Keho reviewed the May 18, 1993 staff report.
Commissioner Zylla asked that the petitioner discuss elevation of the proposal units.

Commissioner Albro stated that the City Council tabled this request previously because
they did not have a majority to approve the 415 vote needed for the rezonLig part of the
application.
Commissioner Wigley asked if the public streets design were slightly narrower than
usual.
Associate Planner Keho responded that the narrower public street design was approved
by the City Council at the Concept Plan stage to encourage the design of public streets
rather than private drives in die development.
Chairman Stulberg introduced Mr. Pat Goff, the petitioner.
Mr. Goff reviewed the previous plans for this development and the new changes in this
request. He said that this request is for public streets, that the east side of the site has
been beefed up with evergreen trees and a berm to buffer the development from the
neighborhood across the street.
Chairman Stulberg opened the Public Hearing.
Chairman Stulberg introduced Mr, Carl Hedberg of 13420 -36th Avenue North.
Mr. Hedberg stated that this plan has come a long way, He asked about the walkway
along Xenium Lane and recommended that the landscaping be done all at onetime at
the start of the project.
Chairman Stulberg introduced Mr, Leo Timmerman of 3630 Wedgewood Lane,
Mr. Timmerman stated that Ids concern was in regard to the price of these homes, and
the thought that lower priced hooses would be located near their neighborhood and

affect theirpmperty, values. He said he felt these homes would not be benefit to
Plymouth. He said this ai% would be an excellent place for a park, not low income
housing.
Chairman Stulberg closed the Public Hearing.
Commissioner Wigley asked the petitioner to discuss the timing for the berm and
landscaping portion of the plan.
Mr. Goff stated that all grading and the street side of the berm would be completed
during the fust phase, hopefully by this fall. He sair, the landscaping would be
completed from the south portion up to 37th Avenue North.
Commissioner Wigley asked Mr. Goff if lie wished to discuss the market value of the
proposed homes.
Mr. Goff described the amenities of the 1,495 square foot homes, and said the starting
price would be $119,900.
MOTION by Chairman Stulberg, seconded by Commissioner Wigley, t recommend
approval of the request by Goff Homes, Inc. for a RPUD Preliminary Plan/Plat and
Conditional Use Permit for 60 single family attached units; and, Rezoning of the.

subject to all conditions listed in the May 18, 1993 staff report.

add a condition stating that an be.nning and landscaping be competed during the fust
phase of the project.

Commissioner Albroasked if abond would be required from the developer to
guarantee the landscaping,

Chairman Stulberg called a recess at 7:42 p.m. The meeting reconvened at 7:52 p.m,

CARLSON REAL ESTATE COMPANY, INC. (93019)
Chairman Stulberg introduced the request by Carlson Real Estate Company, Inc. for
reconsideration of the Land Use Guide Plan Amendment from IP to CR -2; Rezoning
from I-1 to B-2; General Development Plan Amendment; a Site Plan for a 124,996
square foot Wal-Mart Discount Store; Condiflonal Use Permit for outside storage and
automotive repair; a Variance for signage; and a Preliminary Plat to create five lots;
located at the southeast comer of Carlson Parkway and I-494.
Associate Planner Keho reviewed the new materials received by the petit ones regarding
a noise study and baffic study dimussed in the June 2, 1993 staff report.
Chairman Stulberg introduced Mr. Robert Hoffman, representing Carlson Real Estate
Company, Inc.
Mr. Hoffman discussed the advantages of this proposed development to the City of
Plymouth.
Mr. Rick Nan reviewed the new Noise Study. He stated that 3 decibels is the smallest
noise level that is perceptible. He said that this proposed project will cause a 1 decibel
change in the noise level during the P.M. peak hours. He said that in the off peak
hours the decibel change in noise levels were within the State standards. He saidthat
the testing was done at the east side of Cheshire Lane. He stated that the decibel level
varied between 0 and 2 decibels during the week day period, and up to 3 decibels
during the weekend.
Commissioner Wigley asked Mr. Nan if the decibel change is considered a logarithmic
change.
Mr. Nan responded that 3 decibels would be related to noise resulting from a dotibling
of the traffic.
Mr. Dick Wolsfeld discussed the new traffic study. He said they analyzed weekday
afternoons, weekday evenings and Saturdays, and compared these estimates to estimates
of the approved land use. He stated that all the projected traffic levels we better than
or equal to.the'traffic which would be generated front the currently approved land use.
Commissioner Wigley asked if level A is the bestlevel. He said some of the levels
were degrading such as on I-394 & Horn Drive which is now a B and would degrade to
a C. He said he thought that Nu, Wolsfeld stated that traffic levels would be better.
Mr. Wolsfeld responded that he meant that traffic levels would be better than or above
the State standards,

Mr. Hoffman discussed the noise study comparing no development with the proposed
development.
chairman Stulberg opened the Public Hearing.
Chairman Stulberg introduced Ms, Sharon Carrington, of 415 Berkshire lane.
Ms. Carrington stated that her home looks out over this site. She asked what type of
traffic levels could be expected on Sundays.
Chairman Stulberg introduced Mr. Edwin Johnson, of 255 Berkshire lane.
Mr. Johnson stated he looked at the Wal-Mart hours and traffic at the Brooklyn Park
site, and discussed Ids thoughts on how many cars could be traveling to this proposed
site. He also discussed hearing a burglar alarm go off in a car in the parking lot and
said he felt there would be continuous noise that would affect Iris home. He said that
this proposal would depreciate the value of the homes in the area, and that an industrial,
use would be more compatible with the neighborhood. He discussed the affect of
headlights from cars departing from the site during the evening hours which would
disturb the people in the existing homes. Mr. Johnson stated that he felt this
development proposes a serious threat to the homeowners in this area.
Chairman Stulberg introduced Mr. Jerry Leininger; of 13624 -5th Avenue North.
Mr. Leudnger stated that Le felt the noise from the traffic generated from this proposal
would be very disturbing to the homeowners in the area.
Chairman Stulberg introduced Mr. Chris Mosentine, of 13735 Sunset Trail.
Mr. Mosentine stated that there is a Target and P & M Store close by and that traffic
levels would increase because of comparison shoppers comparing prices between the
thrre businesses. He staled that because his property sits at such a high elevation he
will have a full view of the parking lot. He said that Carlson Real Estate should have
to stay with their original approved plan for this site.
Chairman Stulberg introduced Mr. David Nygren, of 420 Berkshire Lane.
Mr. Nygren stated that he did not see any improvement in the projected traffic noise
levels in the newly presented traffic study. He said that traffic noise is the most
offensive noise to humans.

Mr. Wolsfeld stated that Sunday afternoon traffic would be lower than Saturday
aftemoon traffic, which is the heaviest traffic time.. He discussed the Levels Of Service
in the Gaffic,study.
Mr. Nau stated that Saturday and Sunday noise levels were comparable. He said that
more traffic is generated at Wal-Mart Stores on Saturdays than on Sundays, and that is
why Saturdays were used in the comparisons..
Chairman Stulberg asked if comparison shopping was weighed for the traffic study.
Mr. Wolsfeld stated that when there is competition in the area there is generally less
trip generation, and this is taken into account for a traffic study.
Chairman Stulberg asked what could be done about headlight disruption from the site.
Mr. Hoffman discussed the proposed landscaping for the site, fencing, and proposed
landscaping on the rear lots of neighbors if they would want this screening. He said
some of theproperty across from these neighbors is already zoned commercial retail.
Commissioner Zylla stated that any industrial use developed on this site would have to
meet the State standards, and that they are numerous industrial type businesses that
could be developed on the site besides a food distribution warehouse, as was used in the
comparison analysis for the traffic and noise studies. He said that most of the
information discussed regarding noise and traffic was very technical. He said that
cumulative impacts were not discussed.
Commissioner Zylla stated that the thought of increasedtrafficbecomes cverwhehning,
and he did not see any significant changes in the new information which was submitted.
He commanted that this is a nice project but in the wrong place, and he felt the
Commission should abide by the previously approved plan for the industrial use of this
site.
MOTION by Commissioner Zylla, seconded by Commissioner Wigley to stand by the
Planning Commission's previous recommendation to deny the Land Use Guide Plan.
Amendment for this site.
Chairman Stulberg stated that we are reaffirming the past decision, and that the new
information does not change the Commission's previcus decision, nor the scope of their
decision:
Commissioner Zylla commented that he was appreciative of the way the homeowners
who opposed this application prepared and organized their testimony. He said he felt
there was excellent planning for the public hearing held jointly by Minnetonka and

Plymouth, which offend the Commissions a look at the impact of the project as a
whole.
Commissioner Ogley commented that the fundamental issue of this request was to
change the guiding, which changes the "game" for a great number of people.
Chairman Stulberg said that he viewed this inquest as a land use issue and that this
project was not an appropriate use in this location. He also stated that his comments
and those of Commissioner Zylla were personal views and did not rcpr>sent the views
of the entire Planning Commission.
Roll Call Vote. 7 Ayes. Motion carried on an unanimous vote..
W. Hoffman requested that this proposal not go to Council until July 19 1993.
