MEMBERS ABSENT. Commissioners Dentis tylia and Ed Albro, STAFF PRESENT: Director Chuck Dillerod, Associate Planner John Xe—.ho, and Planning Secretary Jackie Watson. MIPII7 : Motion by Commissioner Stimson, seconded by Commissioner Wigley to approve the January 27, 1993 Planning Commission Minutes. Vote. 4Ayes. Motion Carded. TERRY AND DIANA PEDERSE " (43003) Chairm an Stulberg introduced the request by Terry and Diana Pedersen for an Amended PUD Plan and Conditional Use Permit to allow a fence to exceed the ordinance maximum height in the front yard at 12605 -52nd Avenue North, Associate Planner John Kelm reviewed the January 20, 1993 staff report. Chairman Stulberg introduced Terry and Diana Pedersen. Mr. Pedersen stated that some information regarding their request was not discussed in the January 20,1993 staff report. He said that in 1986 he called the City and was told that his plans to build a 6 foot fence would not be in violation of the ordinance. He said they constructed the fence in good faith. He said he had talked to former Community Development Director Blair Tremere after they were noted that their fence was in violation of he Zoning Ordinance. He said that Mr, 'Tremere stated that everything was taken care of and they could leave the fence as constructed. Mr. Pedei;en stated that when they were secetdly again notified of the fence violation they were surprised because they thought the ;fence was not a problem, He said they immediately contacted the City and submitted the necessary application for time amendment. He said that they had received incorrect information from the City, but they wanted to be responsible citizens and would work with staff on this issue. 0* 0 Planning:Conunission Nnutes February ll),1993 Page tl21 Commissioner Wigley asked the Pedersen's if the fence had added to their enjoyment of the property. Mr. Pedersen responded that it had. Chairman Stulberg asked if in 1986 when they had discussed the fence with the City, they felt they had done the right thing by discussing the fence prior to construction. Mr. Pedersen stated that they would have gone through the application process priorlos construction had they known the fence would be in violation of he ordinance. Chairman Stulberg opened the Public Fearing. Chairman Stulberg introduced Mr. Kevin Erickson of 5125 O"ew lane. Mr. Ericksonstated that he owns the property immediately south of the Pedersen home. He said that the fence does not obstruct traffic or cause any problems for their home; Chairman Stulberg closed tate Public Bearing Chairman Stulberg asked if staff had any problem regarding obstruction of sight distance when they reviewed this application. Associate Planner Keho responded that they did not. Director Dillemd stated that this home is situated on a lot which actually has two front Yards because of the location of the two streets on two sides of the property. MOTION by Commissioner Wigley, seconded by Commissioner Syverson to recommend approval of the request by Terry and Diana Pedersen for an Amended PUD Plan and Conditional Use Permit to allow a fence to exceed the ordinance maximum height in the front yard at 12605 -52nd Avenue North, subject to all condiQons listed in the January 20, 1993 staff report. Motion carried unanimously, HAZELDEN PIONEER HOUSE (93006) Chairman Stulberg introduced the request by Hazeiden Pioneer Hpuse for a Conditional Use Permit to add ouipatient treatment at 11505 -36th Avenue North. Associated Planner Xeho reviewed the January 21, 1993 staff report, n Planning CommissionUnules February,10,1993 Page k22. Chairman Stulberg introduced W. Mike Schiks, representing the petitioner. Mr. Schiks stated that be had met with the neighbors to discuss this request He said he was in agreement with the staff report. Commissioner Wigley asked, if the facility was currently at full capacity. W. Schiks responded that they were not up to full capacity. He said this request for q outpatient services will allow them to serve this public need. ii Director Wenrd stated that staff reviewed the traffic issue, and he said that the traffic h of 16 outpatients would not be noticeable in the heavy "background" traffic of 36th Avenue North. Chairman Stulberg opened the ]Public Hearing: s Chairman Stulberg introduced Mr. Damien McEurath of 3610 Evergreen lane. R r W. McEurath staled he supports the request bylazelden Pioneer House. He said he is also speaking for some of his neighbors. He said they aftended the open house held to inform the neighbors, imd, they were all very impressed with t' a facility. Mr. McEurath stated that he 4 -Wes next door to Hazelden, and saidthey ;ire an excellent neighbor. He said he does not see any traffic problems resulting from the outpatient services. Mr. MCEurath stated that the (..ity of Plymouth should be proud to have such a facility located here. Chairman Stulberg introduced Mr. Tim Raabe of 11390 -36th Place. i Mr. Raabe stated that he lives across the street from Hazelden and is in favor of the request. He said that the Nazelden PioncerHouse has been a good neighbor. Chairman Stplberg closed the Public Hearing. M IXON'by Commissioner Wigley, seconded by Commissjoner Stimson to lecommend approval of the request by Hazelden Pioneer House fora Conditional Use Permit Amendment to add outpatient treatment at 11505 -36th Avenue, subject to all conditions listed in the January 21, 1993 staff report. Motion carried unanimously. 0 Planning Commission Nnu•.es February 10, 1993 Page N23 TIMOTHY AND PATRICIA O'BR>EN (93007) Chairman Stulberg introduced the request by Timothy and Patricia O'Brienfor and Amended PUD Plan and Conditional Use Permit for an addition at 4615 Trenton Circle. Chairman Stulberg waived the review of the January 21, 1993 staff report. Chairman Stulberg introduced Mr. Tim O'Brien. Mr. O'Brien stated that be was in agreement with the January 21, 1993 staff report. Chairman Stulberg opened and closed the Public Hearing as there was no one present to speak on the request. Motion by Commissioner Syverson, seconded by Commissioner Stimson to recommend approval of the request by Timothy and Patricia O'Brien for an Amended PUD Plan and Conditional Use Permit for a house addition at 4615 Trenton Circle, subject to all conditions listed in the January ,21,1993 staff report. Roll Call Vote. 4 Ayes. Motion carried unanimously, Director Dillerud told.the Commissioners that staff has been meeting with the Minnetonka City staff and representatives from Wal -Matt to discuss a proposal that will soon be submitted to both cities for a Wal-Mart and Sam's Club. He said that a joint Public hearing is anticipated with the Commissions of both cities to discuss the proposal. Director Diilemd polled the Commissioner as to their preference for a joint meeting on either Wednesday, March 31 or Thursday, April 1. The Commissioners consensus was that the joint meeting with Plymouth and Minnetonka Planning Commissions be held on Wednesday, March 31st, at 6:30, at Minnetonka' City Hall.
