because that church does not ,have development expertise. The
lets will, hopefully, be developed by another entity. The
church looks to the City to work out the development plans
with that entity.
Pommissioner Harofsky inquired if the balance of the, lots
would ;be platted as an out,lot. Mr.. Margulies stated that
the Final Plat will show an outlot An application to plat
that property 'would be submitted' by someone ether than the
church for processing and City approvals.,
Commlissioner Marofsky inquired about. 'the location for Olive
Coordinator Dillerud stated that with the platting of that
property, Olive Lane should be placed further to the east to
preserve the low land and .natural area. This may produce
some: lots that would be narrower and have less depth than
Ordinance minimums, however, even with possible variance
consideration, its is important to preserve the natural
fecn-jres of the property,
Chairman Paubaintroduced ' Mr. Stuart Turnbull, Wayzata
Evangelical Free hur^h,:who stated that the ouilot will not
be developed by the chur-h. They would sell it to
developer who in turn would submit the proper plans to the
r ty. He- =noted the church auditorium has 1$000 seats, and
the parking expansion is needed for current church
functions.
Chairman Pa;uba opened the Public Hearing.
William'Baxter, 17635 6th Avenue North; stated that he Is
homeowner in Hawtbo ,ne Pends, and th-- residents have
petitioned' the C ty for official: abandonment ;of 6th Avenue
North. Because of the drought situation, the City 'had asked
for a postponer, nt. Mr. Baxter requested that the record
show they Dave made this request. It was also his wish that
Sth Avenue North never be- connected.,
Hr. Baxter stated that this plan, shows much improvemevXu over,
the previous plans submitted by the church, especidily with
the case taken to preserve the natural areas. However, it Y
is top bad it was; over -built to begin with. He requested
that the. seven .lots as proposed would be for residential`
homes only, and that step, be taken to see that this
property would 'never end up as a parking lot.

Mr. Baxter requested the City to reviow their planning and
zoning requirements for the so-called "mega churches.." Re
stated that there was discussion by the City Council on this
matter recently. He stated that Wayzata Evangelical Free
Church is no longer a "neighborhood" church.. This type of
church should be in a commercial' area
Mr. Baxter expressed concern that the church had not lived
up to their commitments to the neighborhood, especially with
respect to .landscaping arta buffering The neighbors do not
believe they have done a ",good job."
He believes there could be other methods of transportation
to the church and that the lot expansion will reduce
property values. Re --,-,idents on the Sth Avenue side want:
specific covenants to prohibit access to 8th Avenue from the
parking lot. It is their contention that the garage should
not be removed, as it would allow access to ;S#h Avenue north
from the backside of the church; ;lot. He said that preserva-
tion of the natural area is very important to the neighbor-
hood and the City-at-larp,
Chairman Pauba inquix rd about the petition for vacation of
6th Avenue North, and the questions relating to 8th Avenue
North." Engineer Harri.so:. stated he was not aware of the
status of these issues.
1r. Stuart' Turnbull stated that the landscaping and berming,
as proposed, exceeds the City's requirements. He has
advised the nei.ghbYvs on several occasions that they should
call him or the Pastor with any problems or concerns ; a-d,
that neither he, nrr Pastan Vawter have :received telephone
calls from oei.ghborhood residents relaying complaints.
Commissioner Marofsky stated that the lots in question are
zoned R -1A, than allows the development of single family
residential homes. The church is a conditional use in the
RY-1A District and if they do not sell the lots they could
return with - future proposal for the property they own that
could` include expansion of the church use.
Ms. Lynne Kravoska 615 Narcissus Lane, sated they Moved in
a; year ago, ddint- they could live with the parking lot
because of the wide berm and screening that had been .instal
led. They also believed the only rtc,ise would be during
Sunday servi.oes, and, they would' be attending church at that
time as well., so It wouldnit be a problem
However, this was not fitre case and many problems have arisen
from tho church functions -and traffic that could be
described as "trespassing -11 late at night

She stated that cars "flood" the cul-de-sac during church
services. On some occasions, but more prevalent during the
school, year and from 11 ' P.M. to z00 A.M., there are after-
hours "visitors" that include kids drag racing their cars
and yelling and screaming, those who park and use the lot as
a "lovers lane".- and, the incidents where cars meet and
something" is passed from one to the other. She related an
Incident when a man was in her ` backyard` at 2.00 A.M. and
went into the yard of an elderly neighbor who lives alone.
She explained that ,;the lot Is too large and is hidden- away
from the street where strange cars or questionable activi-
ties cannot be seen;. They have called the police and by the
time they arrive, the cars andfor people are gone,
She expressed concert) _ about the safety of her home and
family and for the other resi'.derrS who live near' the
church.. She opposes the expansion to the cburch`s parking
lo't.
Bill. Kratoska., 615 Narcissus, confirmed his, wife's state-
ments. He statedthat when they bought their home they
talked to representatives of the church, attended their
services, and were assured that the neighborhood felt the
church to be a good Neighbor. They Yvere given general::
assurance that the church would not expand without working
with the neighborhood and advising them of the plans. How -
ever,, they have found that the neighbors are not as ha.ppv as
the church had lett thein to believe, and that plans were sub-
m'.tted to theCity without advising the neighbors.
He noted that if the church' would have their lot restriped,
they could easily increase the existing .lot by appr-oximatel.

dential neighborhood and he is opposed any further
expans:ion..
Larry gohnson, 17605 8th Avenue 'North, stated that the berm
I. is not enough to screen car light glare from his 'home; the
berm is not maintained regularly-,, and, the shrubs are not
high enough to adequately screen the lot. He reiterated
that church traffic continues to park on the cul-de-sac;
young people skate board, play loud radios; and generally
hang outs, which invites trouble for the neighborhood. He
is opposed to any further expansion of the parking lot.
Chairman Pauba inquired about church functions during week-
days. Mr. Turnbull: .stated' that there is a nursery school
operating ;five clays a week; choir practice is Wednesday
evening; a 'chemical dependency groin meets at the church
and; on Monday evenings the Boys' Club and the curls programs
are held. The. church is closed by 1000 P.M.

Charles VanDeVer e, 705 Oveerislandf Lane,7 stated - that concerns -
he would express have been =voiced. Every Sunday, cars are
parked on 'nth Avenues makingt difficult for him to turn,
into his driveway, He believes there should be "hard" data
provided and good reasons given why these additional parking,
spaces are needed, because even though there is the problem
with on --street parking, there are empty parking spaces in
this lot every Sunday.
Mr. Turnbull stated that 840 people attended church last
Sunday and the ' parking lot was basically full.. The church
shares the concern about on -street parking and have. a shut-
tle bus that runs from the school administration building to
alleviate the problem. The church has paid for this service
for the, past two years.
Commissioner Marofsky inquired whert the church acquire the
additional land;:* Mr. Turnbull stated the church bought the
lard and closed on the sale a year ago, July 15, 1937.,
Chairman Pauba inquired if the church offers only one
service, fir. Turnbull stated they hold two services during
the fall and winter months. However,; shifting to Lwo
services brought in more cars because the youth instruction
program schedules and church' services' core together.
Commissioner Tierney inquired about the late night activity

bull stated he is also very concerned about this. The
church, is closed at 10 p.t4. and, they have talked about
fencing and installation of gates.
Commissioner Tierney inquired why this had not. begin 4nne.
Mr. Turnbull stated it had been discussed,, but lie >cou; -,, tot
answer whether this was ,part of a specific plan,
Charles Lehrman, 810 Queensland Lane, asked why the City
could ; not guarantee that the parking lot would not access
th Avenue North.
Commissioner Marofsky reiterated that his statement
concernod the ;zoning for the property as ft -1A; and, the
church ` as the -property owner, bas the right to sell property
which call be developed with single family horses. If they
retain the property, it can be pvoposed for use by the
church,
Mr. Lehrman stated he saw no .mason that a condition or
requirement could not be placed that traffic from the church

recommend that. unless .long --standing covenants can be placed

on this propos-dl it should be denied. There is a large
development beino contemplated on, the east; side of Hadley
ti4ke and the residents on 8th Avenue need this protection.
Mr, Gehrman stated that he is also concerned that the

by this expansion. He opposes approval for this plan unless

been flooded four time; and he is concerned that the parking

Engineer Harrison explained the requirements for the grading
and drainage, Chairman Pauba advised :that Mir, Kuehn check
with the Engineering Department about the existing problem.
Wayne Bourne, $30 Narcis-.us Lane, stated he is the. President
of the Hawthorne ponds Homeowners Association, but is spear-
inq as a homeowner,. There has been a credibility b)-eakdown
between him, the church and ,at times, the City. N
explained _ the drainage problems af`feoUng his. property; that
the drainageand landscaping was not a+ compini h_ed. b the
church as pxomi$ed and his property has become a "weedy
marsh."
The City has had to come out. to clean up the garbage and
debris at the site, and 'the pcl.i.ce have been called regard

Jerry. ,Fadden, Wayzata Evangelloal, Free Church, stated that:

and had it resurveyed per specifications. The grade was
foundto be correct. The cQv rt under Highway 101 was,
inches higher than the plan, this is a problem to be
resolved by the State of Minnesota. The church hdS a "ways

Chairman Pauba stated he is concerned that the complaints`
relayed by the neighbors are long-standing.

The proposal does not meet the Conditional Use Permit
criteria, of the Ord}n.-AAce for public welfare, saftt,y,
and comfort; that it would increase -traffic, would
substantially restrict the balance of the residential:

the site; and, could be injurious to the use and enjoy-
ment of other p.rope t,, in the immediate vicinity.

He noted that in reviewing the previous proposal's Commis-
sioner Marofsky had recommended; that a traffic consultant
study the parking lot layout, if this has not been

was revi-3wed in October, 1937, the onderstandi.ng was that
everyone would work together. Although this proposal is
mu,.h batter than the original plan, there is substantial
opposition to it and it beoome6 a matter of precluding

additional parking spaoe could be attained on the lot as it

Mr. Glcwa stated their -concern about the sp cif is requlro--
mutt for no driveway access for Tracts 81 ', and G, from
Niagara Lane, and the shared drive requirement. They
requested that the number of private drive access points be
limited to seven, to be determined with site development.
Mr. G ,owa introduced Mr. Ron Erickson,. KKE Architects, Inc.
4r. Erickson stated he would first discuss the issue of
transition. He explained that to sepa.ratt buildings before
they are constructed poses major problems for site planning
and could cause missed opportunities for the best use and
design of the sites. This property will. be developed
site -by -site; installation of utilities will be phase;',' arid,
the sites will have individual building owners ,and t:ena.rits*
Completing the transition and landscaped areas the entre
length of the area wouldnot fit ' in with site -key --sine
development, and it is important to be exacting when placing
landscaping for maximum aesthetics arra superior screening,

this stage of development.: Again, it is important to
construct the ponds for ut itarian and aesthetic purposes
that, they are integrated with the construction and design
feature:> of the total area.
Mr. Erickson assured the Commission that this will
happen in a timely manner. Its ' integration witt* the
construction will produce more irittlerestinq and, aestheV. -ally
pleasing sites upon completion of the development.
Mr. Erickson stated that access is critical for the users
and owners of these buildings. Shared drives for two separ-
ate developments, that ;may not occur at the same time, makes
it difficult in this market, The access shown on their
plans is that which had .been shown on previous City of
Minneapolis plans that have been approved. it is they same
access that; buildings across the t-,,treet have today.
Access for service: vehicles was discussed. sir. Erickson
stated that the in -hound service vehicles would be coming
onto the site during off peak hours. and the proposed access
paint would be for in -bound tuck ' tra"ic coming to the
docks.
He said that as each .site :develops, there will be uniqu t
requirements for service access for individual property
owners, It would be 'preferable to limit the number of
access paints,;rather than tying it to specific parcels.

Coordinator D ll.erud stated the quer tion of access was
raised by the petitioner from a design standpoint. In this
instance, it would be appropriate for the Commission to re-
view the plans at this stage of the development.
Commissioner Wire stated it would .seem more appropriate to
reviews the ite plan; on an individual basis.. He would be
opposed to approving a Solan=:et number of access points as
proposed.
Gl owa stated they would also prefer site -by -site plan
review, with the exception of the "Productivity, Inc."
site. leis particular access point is desired by company
owner,
Commissioner Marofsky stated he is concerned with the change
to the internal circulation and suggested that the street
loop from 21st Avenue knackthrough to 25th Avenue. He
inquired if the petitioner had considered this ' option.

Commissioner Marofsky inquired if the Engineering Department
had studied this alignment? ' city Engineer Harrison stated
the roadway would need an appropriate angle, but they had

Further discussion ensued regarding the full transition and
the petitioner's concern that in this marketplece,; i t, would
be difficult: to attain the optimum saleability for sites
where the; building, ownership would ;have no choice in the
matter, of designing access to their site.
Mr. Glowa stated that with light manufactur ng., office/
showroom -type d'evelopmen, building owners would not favor
shared drives.
Commissioner Zyll:a inquired whether individual site plans
could comb:i.nc .logs? Coordinator kii herud answered affi:rma
tivelyi Mr. Ron Erickson stated this would be likely.
Commissioner Zyl.la stated he would rather not addrss the
curb cuts at this time. The Commission could give direction
and the specifics should be handled at the time of Site Man
submittals.

City boundaries. Coordinator Dillerud explained what the
local: service is tied to the Land Use Guide Plan for the
City* Commissioner Zyll,a stated his concern i ss not with the
technical size, butt if the size 'is predicated on the land
use guiding,
Commissioner Zyl.la Inquired about the area sur -charge -4nd
down guiding property. He observed that a property owner is
penalized for a Land Use Guide Plan .Amendment Lhat would

this is not a proper response ,to the market Uday, The
market is a barometer to consider for overall City planning
Commissioner Vire stated the Commission should receive
information to make it easier to understand the financing
for such services; and, concurs with Commissioner Zyll
regarding the reduction of density.

sment and street assessment costs could "kill." good develop-
ment plans. He noted the Graham development land use quid -

Commissioner Wire suggested that a staff report be prepared
to inform- the Commission regarding the City's financial,
plans and cost features for the items listed in each Capital
Improvements Program.
Commissioner Wire expressed hi,s —oncern regarding the "water
problem" in the City this. summer. Plymouth dries not seem to
have an adequate water supply and this is, an ;important
consideration that should be addressed with the report o

Engineer Harrison stated that the City has. stepped up the
pace with plans for a well on the water filtration site:; and
other areas are under consideration for future well sitesa
Commissioner Wire stated that the City .must adequately; plan
for high water use during the summers months, and more

quate to meet the rate of residential development ,in the
