Mr. Eicher stated ,the owner is conderned because of the
contract with Amoco, and he questions if in 'fact the tank
replacement would not be more important than the canopy'

Public Works Director Fred Moore responded that the
thoroughfare planning is a major issue that has a bearing on
the reque te; ! ` ariaAice. ,Iighway 55 is a major arterial,
South Shore Drive and19' h Aversue Horth are major col.l.ec-
Ors; access to create Highway 55 will be limited by ch ngcs
to th(- intersections. Since s 72,. the Thoroughfar plan :has
shown projected road improvements and construction._ He
noted that proposed development plans by Ryan Construction
and the developer of the g if course property, in that same
area, has resulted in traffic studios that reflect needed
improvements to the street,; system network. For example
improvements to the inwersection of South Shore Drive and
State <Highway 55 would be need;",J by 1995, based on approved,
development. Work on these development plans is underway at
this time., The .intersection is not in the 5 -year Capital
Improvement; Programs (Clt'), but as development goes on, this

Mr. Moore explained that there are no firm design plans.
Thi-f are two items affecting the existing drive from this
facility that are definite; South ;shore Drive will be closed
with no access to Highway 5 ' and the frontaqz road will need
to be closed at; South Shore Drive with access from the east,
f back to tho north. The requested variance would put the
canopy to the frontage road. where it would conflict with
changes to the thoroughfare confiqurat:i.on in this .area.'
Mr. Richard Lina, Applicant., inquired what would he left to
the site for access, the r' need answers -to ' protect their
business.: He stated that he had reviewed Plan A-2 for the
frontage road between the trailer court and the station, and
was toldi earlier this sprints that, this- was the plan of
choice, . fie is concerned that: they have been left in the
dark over this.
Commissioner Zy1la stated he does hot disagree: with the
future roadway modifications that impact the , property, but
It seems that the staff report is too strop in, .its
recca stenda:tion which is based upon an uncertain future
date. lie suggested that if the Commission consideration is
for denim, that the first two bases list;eo in the staff
report draft: recommendation be deleted, as It is not;: fair to
base their recommendationion on something that may be far into

Commissioner Wire asked about road alignment and plans for
the frontage road. Director Moore exrl ilned the; proposed:
cul-de-sac to the east for access tv s property. The
frontage road is owned by the State of xsota and changes

Commissioner Plufka stated he does not see the necessity t
remove any trees. The residential neighbors near this

concern with the traffic on Vicksburg Lane, the 50 mph speed
limit is `dan,4erous and should be lowered. He reiterated
that as proposedl the commercial area is "too big."'
Barry 'Winston, 16005 26th Avenue forth, stated he has been
attending Commission and Council meetings since the earl
1980's and: agreed with Mr. Beyer that the City had always`
told him this would be a "small." convenience center. He
stated the matter had been discussed as to the need: for this
shopping area and the City stated it was needed for the
walking traffic"; he does not see the need for a' qas
tatien in that case
Chairman Pauba closed the Public 'Hearing.
MOTION by Commissioner Plufka, seconded by Commissioner WTION TO APRVIS
Zylla to recommend approval ` for the HPOD Preliminary Plan/'
Pta.t subject to the ten conditions- listed in the )une 28,
1988 staff report'.
Commissioner Plufka asked that, not withstanding Condition
No. 4,, the rec rdi ti ow a recommendation to the City Council
that the plans for the "cattle cro,sinq" be abandoned.
Cori issi,oner Pl;uf'l(a further stated that this plan is sub-
stantially the same: as those seen originally and is no more
than ' iwhai was contemplated witn the development of this
area. TI -he plan shows no provision for any large scale
tenant such as with a typical reg.onal/area foodstore. His
concerns would be for a resolution to, the matter of. the
cattle oarossing"",7 and no access to Vicksburg Lane or at
least approval for an exit only.
Coomissi.oner Marofsky concurred, stating that the scope of
this proposal is essential 114 the sane as` seen with previous
plans. He sees some pr(ffiem` with building design. and. that
the site desi,n should not attract traffic from i.cksb;.,rg
arae, but should emphasize the access from 22nd Avenue
North

Mr. Tom Bisanz stated that ho agrees with Mike Pflaum's corgi-.
menu regarding. the "ca d' Gi e _cross no"_ e s tea ted they have
met with the Parks and Recreation Director concerninct alter-
natives to the tunnel, their preference would be for an
above-grade pedestrian-way.

Commissioner Marofsky explained he is merely providing

this commercial development much more than a "small" retail
neighborhood center,

on-site; the size of the building wants assuranee there

Commissioner Stulbem stated he would like to see the slides
takers by staff, these were shown to the Commission-.:
Commissioner Marofsky confirmed that only one vehicle was
brought to the site and 'that the employees do carpool,
Chairman Pauba opened the Public Hearinq,, noting that the
peti,ten submitted by the residents is part of the public
record.
Rich Burger, 14.35 Shadyview Lane, lives across County Road 6
and Chas b;en .in residence since April this year.. He was
ho t.hered by the commercial traffic from Highway 12 and the
loading an off-loading do near h.s former home He moved to
get away from this type of operation and was very surprised
to get a notice that the City would consider approving a
business operation from A home In this area. He talked with
his neJ9hb{.nrs and they decided to start a petition 'to submit
to the City stati.nq their concerns.
He noted this is not ' a personal, thing, he has nothing
against Hr. Rohman, but < does consider this type of business
as inappropriate for a residential neighborhood. The
activity level and noise is bothersome; them is equipment
parked in the woods and she site is disorganized, and uoat-
tractive, The site is not completely screened from County
Roar, 4 and would be unsightly in winter. He stated ` that
Mr. Rehman had been loading and unloading equipemnt on
Ranier Lane which was disturbInq. lie believesthe site
activity is at a much higher level than' explained by the
petitioner. He is interested in the restrictions that can
be imposed on this business; and, requests that the equip-
ment. be moved to a commercial area.
Chairman Pauba explained the conditions of approval for a
Condi tionai Use Permit, and that any changes to the Homy
Occupation would .require a re -hearing and re-evaluation by
the Commission ind City Cbvncil.
Dave Meilen; 135 'troy lane, stated than this business is
operating now and no on has stopped it, even though Mr.
Rahman has no permit, This type of business ha!: no place in
a residential neighborhood. There are ,safety factors wi,tt
the ,q .!pment being, "-attractive nuisances,, to children play-
ing in the pare nearby4 He believes the appearance- of the
property detracts Prom the propert.y values for ' the other
Domes in the neighborhood.
W E. Saloyloh,, 1750 troy Lane, has, lived in his home since
90 and opposes the granting of this Conditional Use
Rermi, t This area is a. beautiful part of Plymouth and hav-
i.nq a business here would affect the residential character
of the area.

Chairman Pauba introduced the request, reading of the June KAROLD K. LEYSE
1988 staff report was waived. Chairman Pauba introduced RPUD PLA. Ali,
Mr. Leyse who explained his application to add a third stall COWI:TIONAL USE
onto his garage. He did ' riot believe this would set a PERKTOWNT
precedent:, as various n i.ghbo.s have three car garages, but 813076
they do not have a uniquely shaped lot such as he owns.The
cul--de-sad curve shortens the lot depth it the garage. He
stated tett if the recommendation is fcr denial, ' he would
appreciate the time to bri.nq in, pictures and slides of tris
property 'For reconsideration of his application.
He noted that the Notice sent to property= owners wasincor-
