HomeMy WebLinkAboutCity Council Resolution 2003-312CITY OF PLYMOUTH RESOLUTION 2003-312 REVISED RESOLUTION 2002-504 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "SERENITY ON HADLEY LAKE" FOR COLDWELL BANKER BURNET FOR PROPERTY LOCATED SOUTH OF 8TH AVENUE, WEST OF QUEENSLAND LANE, AND EAST OF HADLEY LAKE (2002055-F) WHEREAS, Coldwell Banker Burnet has requested approval of a final plat for Serenity on Hadley Lake, to allow the creation of nine (9) single-family lots on the 12.1 -acre site (9.1 net acres) located south of 8th Avenue, west of Queensland Lane, and east of Hadley Lake; and WHEREAS, the property is legally described as follows: PARCEL A All that part of the South half of the Northeast Quarter of Section 31, Township 118 North, Range 22 West, described as follows: Beginning at the Southwest corner of the South half of the Northeast Quarter of said Section 31; thence East along the South line thereof 958.95 feet; thence North 647.53 feet; thence West 973.67 feet to the West line of said South half, thence South 654.6 feet to the point of beginning; except that part thereof lying in the plat of FAZENDIN-KROGNES S ADDITION. Also Beginning at a point on the East line of the Northeast Quarter of the Southwest Quarter of Section 31, Township 118 North, Range 22 West of the 5th Principal Meridian distant 9.8 chains South from the Northeast corner thereof, thence North along the East line of the West half of said Section 1301.4 feet; thence West parallel with the North line of the Southeast Quarter of the Northwest Quarter a distance of 240 feet; thence South parallel with said East line of the West half of said Section a distance of 997.32 feet; thence Southwesterly to the point of beginning. Resolution 2003-312 (2002055-F) Page 2 PARCEL B Lot 16, "WAYZATA FARMSTEADS", according to the recorded plat thereof, Hennepin County, Minnesota, except the south 125.70 feet of said Lot 16, as measured at right angles to and parallel with the south line of said Lot 16. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat; and WHEREAS, on November 12, 2002, the City Council approved Resolution 2002-504 and that resolution is hereby superceded and replaced by this resolution. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Coldwell Banker Burnet for a final plat for Serenity on Hadley Lake; and FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves nine single-family lots in accordance with the plans received by the City on October 22, 2002, and with the revised final grading plan, revised tree preservation plan, revised tree preservation table, and tree planting plan received by the City on July 9, 2003, except as may be amended by this Resolution. 2. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication for eight (8) additional dwelling units, pursuant to the Dedication Ordinance in effect at the time of recording the final plat. 3. Development standards shall be specified by the RSF-1 zoning district, other than the lot width of Lot 5 and the length of the cul-de-sac for which variances were granted. No other variances are granted or implied. 4. Appropriate legal documents regarding Homeowners Association documents, covenants and restrictions, as approved by the City Attorney, shall be filed with the Final Plat. Such documents shall specify that the homeowners association shall be responsible for maintenance of the cul-de-sac island. 5. Because this site lies within the Shoreland District for Hadley Lake, all the lots within this subdivision are limited to a maximum impervious surface coverage of 25 percent, or as may be amended in the future. The purchase agreements for each of the lots, as well as any marketing materials for this development, shall clearly state that the maximum impervious surface coverage, including swimming pools, shall be limited to 25 percent of the lot area. 7. Prior to filing of the final plat, the developer shall provide the City with a trail easement between the turn -around portion of the new Shadyview Lane cul-de-sac and the City -owned right-of-way located to the east. 8. Compliance with the City's tree preservation regulations. The revised plans received by the City on July 9, 2003 indicate tree removal of 53.4 percent. Consequently, the developer must provide tree reforestation on the site in the amount of 1.25 inches for every 1.0 inch removed in excess of the 50 percent threshold—which totals 387 inches. 9. Any signage shall comply with the Sign Ordinance. 10. Prior to issuance of building permits, permanent wetland buffer monuments must be installed pursuant to ordinance requirements. 11. A turn -around area shall be provided on Lot 5 pursuant to City specifications due to the over 150 -foot length of the driveway, or the home on Lot 5 shall be sprinkled. 12. Prior to issuance of building permits, submission of the required Financial Guarantee and Site Improvement Performance Agreement (SIPA) for installation of landscaping in the cul-de-sac island, wetland buffer monuments, and trees as shown on the tree planting plan received by the City on July 9, 2003. 13. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Street names shall comply with the City Street Naming System. d. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. e. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. f. Location and number of fire hydrants shall be approved by the Fire Division. g. Prior to filing the final plat, fire flow data shall be submitted. h. A pond maintenance agreement is required between the developer and the City for the water quality ponds.
