HomeMy WebLinkAboutCity Council Resolution 2003-272CITY OF PLYMOUTH RESOLUTION NO. 2003-272 RESOLUTION APPROVING SUBURBAN HENNEPIN REGIONAL PARK DISTRICT PURCHASE OF PROPERTY (25-118-22-43-0004) WHEREAS, the Suburban Hennepin Regional Park District (Park District) has an objective to provide a system of regional trails and greenways with interconnections; and WHEREAS, the Park District has undertaken to acquire, construct and maintain the Luce Line Trail and Luce Line Trail Extension, part of which is within the City of Plymouth; and WHEREAS, the Park District wishes to acquire the property in the City of Plymouth that is described on Exhibit A attached hereto to provide a connection between existing trail segment properties already owned by the Park District; and WHEREAS, the Park District's statutory duties include the acquisition, development and maintenance of large parks, wildlife sanctuaries, forest and other reservations, and means for public access to historic sites and to lakes, rivers, streams and to other natural phenomena, and acquisition, construction and maintenance of recreational trails; and WHEREAS, the Park District's mission is to promote environmental stewardship through recreation and education in a natural resources based park system; and WHEREAS, the City recognizes the advantages to the public in having the Park District acquire recreational trail property in Plymouth; and WHEREAS, Minn. Stat. Sec. 398.09(b)(1) states that the Park District may not "acquire real estate by purchase or condemnation which is located within the boundaries of an incorporated statutory city or city unless the governing body of such statutory city or city shall have consented thereto by resolution duly adopted". NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Plymouth that it does hereby grant to the Park District consent to acquire by purchase the Property as described on Exhibit A to this resolution. Adopted by the Plymouth City Council on June 10, 2003. EXHIBIT A All that part of Government Lot 4, Section 25, Township 118, Range 22, described as follows: the East 5 feet of the West 205 feet of said Government Lot 4 lying North of the right of way of the Minnesota Western Railroad, according to the United States Government Survey thereof and situate in Hennepin County, Minnesota. Being registered land as is evidenced by Certificate of Title No. 117209.
