APPROVING STIPULATION OF SETTLEMENT FOR
PARCEL NO'S. 44, 45, AND 45A AND STIPULATION OF SETTLEMENT
FOR PARCEL NO. 47 BETWEEN THE CITY OF PLYMOUTH AND
VINCENT M. HUGHES, ET AL.

WHEREAS, by Resolution No. 2002-177 the City authorized condemnation proceedings
under the "quick take" statute for Parcel No's. 44, 45, 45A and 47 which are necessary
easement areas for the widening of County Road 101 as part of the improvement project;
and
WHEREAS, the City hired an appraiser who determined an appraised value of $108,076 for
Parcel No's. 44, 45, and 45A and $48,904 for Parcel No. 47 and these sums were deposited
with the District Court Administrator on or about October 10, 2002; and
WHEREAS, an agreement was reached with the Vincent M. Hughes, et al. property owners
prior to the condemnation hearing scheduled to begin on May 20, 2003; and
WHEREAS, the stipulation of settlement for Parcel No's. 44, 45, and 45A includes a total
payment of $142,554.95 and the stipulation of settlement for Parcel No. 47 includes a total
payment of $57,454.27; and
WHEREAS, the City Attorney is recommending payment of these amounts agreed to with
the property owners subject to City Council approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA: That the stipulation of settlement between the City
of Plymouth and Vincent M. Hughes, et al. for the acquisition of easements as defined as
Parcel No's. 44, 45, and 45A at a total payment of $142,554.95 and the stipulation of
settlement for acquisition of easements defined as Parcel No. 47 for a total payment of
$57,454.27 are both hereby approved and the City Attorney is authorized to sign the
stipulations of settlement.
