RESOLUTION 2003-239
APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCES FOR A
5,300 SQUARE FOOT COMMERCIAL BUILDING ON PROPERTY LOCATED AT
3400 KILMER LANE NORTH (2003030)
WHEREAS, P and L Concrete Stamping has requested approval of a site plan, conditional use
permit, and variances for property legally described as follows;
Lot 7, Block 2 Glen Erie Addition, Hennepin County, Minnesota
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by P and L
Concrete Stamping for a site plan, conditional use permit and variances subject to the following
conditions:
1. A site plan is approved for an approximately 5,300 -square foot commercial building,
according to the plans and application received by the City on March 19, 2003 and April 15,
2003, except as amended by this resolution.
2. A conditional use permit to allow up to 40 percent of the gross building floor area for storage
of warehousing/indoor storage is approved, based on the finding that the applicable
conditional use standards as listed in Section 21015.02 of the Zoning Ordinance and the
measurable performance standards listed in Section 21550.07 of the Zoning Ordinance have
been met, including the requirements that the warehousing/indoor storage be accessory to a
permitted use, no outdoor storage is permitted, and the area dedicated to warehousing/indoor
storage area is limited to 40 percent of the gross floor area.

3. Variances to 1) the C-5 district's minimum lot area of one acre; 2) the requirements that no
loading area be closer than 300 feet from residentially zoned properties; and 3) parking lot
setbacks of 10 feet from Kilmer Lane instead of 20 feet are approved based upon the finding
that the applicable variance standards as listed in Section 21030.03 of the Zoning Ordinance
have been met.
4. Variances to fire lanes and structure distance from fire hydrants are approved, except as
amended by this resolution, based on the following conditions:
1. Automatic fire sprinklers shall be installed to protect the building;
2. On-site hydrants shall be installed in approved locations;
3. Fire flow calculations shall be submitted and approved prior to issuance of any
building permit;
4. Approved Fire Department standpipes shall be located in approved locations inside
the building.
5. Any trucks loaded on-site shall be loaded inside the building.
6. The applicant shall revise the site plan and lighting plan in conformance with the grading and
drainage plan and the requirements of the Zoning Ordinance, except that the handicapped
access aisle shall be shown eight feet wide as required by the Building Code instead of six feet
as shown.
7. The applicant shall revise the landscaping plan to include the following:
a. The site layout as shown on the grading and drainage plan;
b. The required number of new trees for the property in conformance with the
ordinance (11 overstory trees, a minimum of 3 must be conifers); and,
c. The entire site must be sodded in conformance with the ordinance.
8. Signage for this site shall be in compliance with the Sign Ordinance. Separate sign permits
shall be required.
9. Trash storage shall be in compliance with the Zoning Ordinance.
10. Standard Conditions:
a. Compliance with the City Engineer's Memorandum.
b. Removal of all hazardous trees from the property at the owner's expense.
c. Compliance with the Ordinance regarding the location of post indicator valve, fire
department connection and lockbox, and fire lane signage.
d. Prior to the issuance of utility or building permits, the applicant shall confirm the 34th
Avenue water main size, a solenoid device shown and the fire lane construction detail shall
be shown on the plans.

e. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement bonds per City Policy.
f. Park dedication fees shall be cash fees in lieu of land dedication in accordance with the
dedication policy in effect at the time of building permit issuance.
g. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started construction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21015.07, 21030.06 and 21045.09 of
the Zoning Ordinance.
