RESOLUTION NO. 2003-228
REQUEST FOR VARIANCE FROM RULES FOR STATE AID OPERATIONS
GARLAND LANE/51sT AVENUE (MUNICIPAL STATE AID ROUTE NO. 165)
AND
SCHMIDT LAKE ROAD (MUNICIPAL STATE AID ROUTE NO. 175)
STATE AID PROJECT NO'S. 155-165-06 AND 155-175-01
CITY PROJECT NO'S. 2022 AND 2023
WHEREAS, the City of Plymouth has State Aid construction funds available from its 2003
allotment; and
WHEREAS, an anticipated project for the construction of Garland Lane/51st Avenue (State Aid
Route No. 165) and Schmidt Lake Road (State Aid Route No. 175) that were anticipated to be
constructed by the City, is being constructed as part of a developer improvement project; and
WHEREAS, State Aid Rule 8820.2800, Subpart 2, requires that only those projects for which final
plans are approved by the State Aid Engineer before opening bids are eligible for State Aid
construction funds; and
WHEREAS, in order to receive State Aid construction funds for the construction of the
improvements, a variance must be granted in accordance with Rule 8820.3300; and
WHEREAS, the City believes that all construction of the roads is in accordance with State Aid rules
except for an approval by the State Aid Engineer before opening bids;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA: That a variance is requested from the Minnesota Rules of State
Aid Operations 8820.2800, Subpart 2, adopted pursuant to Minnesota Statutes Chapters 161 and
162, as they apply to the construction of Garland Lane/51st Avenue, known as Municipal State Aid
Roadway 165, State Aid Project No. 155-165-06 and Schmidt lake Road known as Municipal State
Aid Roadway 175, State Aid Project No. 155-175-01, located approximately one-quarter mile west
of the CP Railroad and north of Schmidt Lake Road;
FURTHER BE IT RESOLVED: That the variance request is for receipt of State Aid funds that are
from the 2003 construction allocation to the City, but with Plan approval after the opening of bids.
