HomeMy WebLinkAboutCity Council Resolution 2003-208CITY OF PLYMOUTH RESOLUTION 2003-208 APPROVING A SITE PLAN AND VARIANCE FOR LIFESTYLE PROPERTIES, INC. FOR CONSTRUCTION OF "BASS LAKE VILLAS" AN 11 -UNIT TOWNHOUSE DEVELOPMENT LOCATED EAST OF TRENTON LANE AND SOUTH OF BASS LAKE ROAD (COUNTY ROAD 10) (2003004) WHEREAS, Lifestyle Properties, Inc. has requested approval of a site plan and variance to allow construction of an 11 -unit townhouse development on property legally described as follows: Outlot E, The Ponds at Bass Creek, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval of the site plan; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lifestyle Properties, Inc. for a site plan and variances for "Bass Lake Villas" an 11 -unit townhouse development located south of Bass Lake Road (County Road 10) and east of Trenton Lane, subject to the following findings and conditions: 1. A site plan is approved to allow construction of an 11 -unit townhouse development, in accordance with the plans and application received by the City on March 21, 2003 and the landscape plan received on March 19, 2003, except as amended by this resolution. 2. Approval of the site plan is contingent upon City approval of the rezoning of the site to RMF -2 (Multiple Family 2) and the preliminary plat. 3. Approval of the site plan is contingent upon verification of the wetland boundaries during the growing season. Should the boundary of the wetland differ from the location currently shown, the applicant will be required to revise the plans accordingly. Resolution 2003-208 Site Plan (2003004) Page 2 4. Variances to fire lanes and structure distance from fire hydrants are approved in accordance with plans and application received by the City on March 21, 2003, except as amended by this resolution, based on the following conditions: a) All buildings shall be protected by a City approved automatic fire sprinkler system. b) Prior to issuance of a utility permit, fire hydrants shall be located in approved locations throughout the development. c) Prior to the issuance of any utility or building permit, the fire flow calculations shall be provided for the new fire hydrants. d) Prior to issuance of a building permit, a City approved fire department turn -around shall be provided on the private drive. 5. As part of the final plat application, the applicant shall submit a site plan showing an additional streetlight at the intersection of the private drive and Trenton Lane. The streetlights shall be substantially similar to those used in the Harrison Hills subdivision to the west. The applicant is encouraged to install the streetlight prior to occupancy of the units. 6. As part of the final plat application, the applicant shall submit a revised landscaping plan which substitutes another specie for the "Canada Red Cherry"; relocates the trees currently shown over utility lines, the private drive, the treatment pond or driveway entrances; and reflects the pond location. 7. As part of the final plat application, the applicant shall submit revised plans illustrating an additional 25 -foot right triangle of right-of-way at the intersection of Bass Lake Road (County Road 10) and Trenton Lane. 8. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 9. The applicant is encouraged to work with staff to make a portion of the development affordable or accessible to first-time homebuyers. 10. Development standards shall be as required by the RMF -2 district. No variances are granted or implied except those specifically noted in this resolution. 11. No access to Bass Lake Road shall be permitted. 12. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to the issuance of a building permit, the applicant shall submit of the required Financial Guarantee and Site Performance agreement for improvements including, but not limited to, installation of trees and wetland buffer signs. c. Removal of all hazardous trees from the property at the owner's expense. Resolution 2003-208 Site Plan (2003004) Page 3 d. With the exception of one building permit for a single model home, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance. h. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Policy. i. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility.
