HomeMy WebLinkAboutCity Council Resolution 2003-207CITY OF PLYMOUTH RESOLUTION 2003-207 APPROVING A PRELIMINARY PLAT FOR LIFESTYLE PROPERTIES, INC. FOR "BASS LAKE VILLAS", AN 18 -UNIT RESIDENTIAL DEVELOPMENT TO BE LOCATED EAST OF TRENTON LANE AND SOUTH OF BASS LAKE ROAD (COUNTY ROAD 10) (2003004) WHEREAS, Lifestyle Properties, Inc. has requested approval of a preliminary plat for Bass Lake Villas, a plat of 11 townhouse lots, 7 single-family lots, a common area lot and one outlot on 8.2 acres located east of Trenton Lane and south of Bass Lake Road (County Road 10); and WHEREAS, the property is legally described as follows: Outlot E, The Ponds at Bass Creek, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Lifestyle Properties, Inc. for a preliminary plat for Bass Lake Villas, subject to the following conditions: 1. Approval of the preliminary plat is contingent upon City approval of the rezoning of the site to RMF -2 (Residential Multiple Family 2) and RSF-3 (Single Family Detached 3) and a site plan. 2. Approval of the site plan is contingent upon verification of the wetland boundaries during the growing season. Should the boundary of the wetland differ from the location currently shown, the applicant will be required to revise the plans accordingly. Resolution 2003-207 Preliminary Plat (2004003) Page 2 3. This preliminary plat approves 11 townhouse lots, 7 single-family lots, one common area lot and one outlot, in accordance with the plans received by the City on March 21, 2003 and the landscape plan received on March 19, 2003, except as amended by this Resolution. 4. Outlot A shall be considered unbuildable until such time as it is combined with property to the east that has street access. 5. As part of the final plat application, the applicant shall submit a site plan showing an additional streetlight at the intersection of the private drive and Trenton Lane. The streetlights shall be substantially similar to those used in the Harrison Hills subdivision to the west. The applicant is encouraged to install the streetlight prior to occupancy of the units. 6. As part of the final plat application, the applicant shall submit a revised landscaping plan which substitutes another specie for the "Canada Red Cherry"; relocates the trees currently shown over utility lines, the private drive, the treatment pond or driveway entrances; and reflects the pond location. The revised landscaping plan shall also include a row of large evergreen trees along the southern lot line of Lot 7, Block 3 to provide a screen to the adjacent lot in the Ponds at Bass Creek development. 7. As part of the final plat application, the applicant shall submit a site plan and plat drawing that shows all single-family lot widths in conformance with the RSF-3 zoning district. 8. As part of the final plat application, the applicant shall submit revised plans illustrating an additional 25 -foot right triangle of right-of-way at the intersection of Bass Lake Road (County Road 10) and Trenton Lane. 9. As part of the final plat application, the applicant shall provide the City with copies of the homeowner's association (HOA) documents for the neighborhood. 10. The HOA shall be responsible for maintenance of the private drive (at 100 percent until such time as the exception property develops), sidewalks, boulevard plantings, wetland buffers, mailboxes, monument signs and association common areas within this development. The HOA documents shall include language to address maintenance of these features. 11. Prior to recording the final plat, the applicant shall submit the required utility and drainage easements as approved by the City Engineer. 12. Prior to recording the final plat, the applicant shall submit a 10 -foot trail easement adjacent to Bass Lake Road across the entire property . 13. Prior to recording the final plat, a pond maintenance agreement is required between the developer and the City for the water quality pond. Resolution 2003-207 Preliminary Plat (2004003) Page 3 14. Prior to recording the final plat, the applicant shall submit the required cross -access agreements to allow the exception property access to Trenton Lane via the private drive. 15. Prior to recording the final plat, the applicant shall submit the required cross -access agreements to allow Lot 1, Block 3 to access Trenton Lane across Lot 2, Block 3. 16. Prior to recording the final plat, the developer shall pay the park dedication fees, pursuant to City Code at the time the final plat is approved, for the total number of units shown on the plans. 17. Prior to issuance of building permits, the applicant must install the required permanent wetland buffer monuments pursuant to ordinance requirements. 18. All units shall be protected with a City approved automatic fire sprinkler system. 19. The applicant is encouraged to work with staff to make a portion of the development affordable or accessible to first-time homebuyers. 20. Development standards shall be as required by the RMF -2 and RSF-3 districts. No variances are granted or implied except those specifically noted in this resolution. 21. No access to Bass Lake Road shall be permitted. 22. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Prior to the issuance of a building permit, the applicant shall submit of the required Financial Guarantee and Site Performance agreement for completion of site improvements including, but not limited to, installation of trees and wetland buffer signs. c. Removal of all hazardous trees from the property at the owner's expense. d. With the exception of one building permit for a single model home, no building permits shall be issued until the final plat is filed and recorded with Hennepin County. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. No building permits shall be issued until a contract has been awarded for sewer and water. g. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. h. As part of the final plat application or issuance of any building or utility permits, the applicant shall submit fire flow calculations in compliance with City Code and other applicable codes. i. As part of the final plat application materials, the applicant shall show the following on the plans: fire lane construction details, temporary access road/water supply policy, and fire hydrant details. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees per City Policy. k. As part of the final plat application, the applicant shall revise plans as necessary to add and relocate hydrants to approved locations, identify the domestic size of the combination fire/domestic water supply line, supply a PIV valve and siamese connection if required, and show fire lane, address and directional signs in approved locations. 1. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility.
