HomeMy WebLinkAboutCity Council Resolution 2003-206CITY OF PLYMOUTH RESOLUTION 2003-206 APPROVING FINDINGS OF FACT FOR THE REZONING OF PROPERTY LOCATED LOCATED EAST OF TRENTON LANE AND SOUTH OF BASS LAKE ROAD (COUNTY ROAD 10) (2003004) WHEREAS, Lifestyle Properties, Inc. has requested reclassification of the zoning from FRD (Future Restricted Development District) to RSF-3 (Single Family Detached 3) for 3.5 acres of land located south of Bass Lake Road and east of Trenton Lane North, legally described as follows: That part of Outlot E, The Ponds at Bass Creek, a plat that is on file and of record in the office of the County Recorder, Hennepin County, Minnesota, described as follows: Beginning at the most southwesterly corner of said Outlot E; thence along the westerly line of said Outlot E, North 33 degrees 04 minutes 13 seconds west a distance of 9.98 feet; thence continuing along said westerly line being a curve, concave to the east and tangential to the last described line, whose elements are: central angle of 46 degrees 11 minutes 16 seconds, radius of 290 feet and arc length of 233.78 feet; thence continuing along said westerly line and tangential to the last described curve, North 13 degrees 07 minutes 03 seconds east a distance of 83.82 feet; thence continuing along said westerly line being a curve, concave to the west and tangential to the last described line, whose elements are: central angle of 44 degrees 04 minutes 38 seconds, radius of 240 feet and arc length of 184.63 feet; thence south 89 degrees 34 minutes 51 seconds ease a distance of 346.46 feet; thence south 00 degrees 25 minutes 09 seconds west a distance of 485.59 feet to the south line of said Outlot E; thence along said south line, north 88 degrees 25 minutes 00 seconds west a distance 134.74; thence continuring along said south line, north 34 degrees 13 minutes 42 seconds west a distance of 61.94 feet; thence continuing along said south line, south 63 degrees 49 munutes 03 seconds a distance of 133.29 feet to the point of beginning. Resolution 2003-206 Findings of Fact (2003004) Page 2 WHEREAS, Lifestyle Properties, Inc. has requested reclassification of the zoning from FRD (Future Restricted Development District) to RMF -2 (Multiple Family 2) for 4.7 acres of land located south of Bass Lake Road and east of Trenton Lane North, legally described as follows: All of Outlot E, The Ponds at Bass Creek, a plat that is on file and of record in the office of the County Recorder, Hennepin County, Minnesota, except that part described as follows: Beginning at the most southwesterly corner of said Outlot E; thence along the westerly line of said Outlot E, north 33 degrees 04 minutes 13 seconds west a distance of 9.98 feet; thence continuing along said westerly line being a curve, concave to the east and tangential to the last described line, whose elements are: central angle of 46 degrees 11 minutes 16 seconds, radius of 290 feet and arc length of 233.78 feet; thence continuing along said westerly line and tangential to the last described curve, north 13 degrees 07 minutes 03 seconds east a distance of 83.82 feet; thence continuing along said westerly line being a curve, concave to the west and tangential to the last described line, whose elements are: central angle of 44 degrees 04 minutes 38 seconds, radius of 240 feet and arc length of 184.63 feet; thence south 89 degrees 34 minutes 51 seconds east a distance of 346.46 feet; thence south 00 degrees 25 minutes 09 seconds west a distance of 485.59 feet to the south line of said Outlot E; thence along said south line, north 88 degrees 25 minutes 00 seconds west a distance 134.74; thence continuing along said south line, north 34 degrees 13 minutes 42 seconds west a distance of 61.94 feet; thence continuing along said south line, south 63 degrees 49 minutes 03 seconds a distance of 133.29 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD (Future Restricted Development District) to RMF -2 (Multiple Family 2) and RSF 3 (Single Family Detached 3); NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD (Future Restricted Development District) to RMF -2 (Multiple Family 2) and RSF 3 (Single Family Detached 3) for 8.2 acres of land located south of Bass Lake Road and east of Trenton Lane North, based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and plans. 2. The applicant has stated a willingness to work with the City to make a portion of the development available to first-time homebuyers. Resolution 2003-206 Findings of Fact (2003004) Page 2 3. The proposed development meets lot area and dimension requirements of the RMF -2 and RSF-3 zoning district. 4. The proposed RMF -2 and RSF-3 zoning allows a development that meets the City's density goal specified in the City's land use plan. 5. There would be adequate infrastructure available to support the RMF -2 and RSF-3 zoning and the single-family and townhouse development proposed for this site.
