HomeMy WebLinkAboutCity Council Resolution 2003-192CITY OF PLYMOUTH RESOLUTION NO. 2003-192 RESOLUTION AUTHORIZING PAYMENT OF SALARY DIFFERENTIAL FOR MINNESOTA NATIONAL GUARD AND RESERVE FORCES ON ACTIVE DUTY WHEREAS, the City of Plymouth employs individuals who are, at the same time, serving our State and Nation as a member of the Minnesota National Guard or a reserve component of the armed forces of the United States; and WHEREAS, the events of September 11, 2001 remind us of the benefits the service of these individuals bring to the citizens of Plymouth, our State and Nation; and WHEREAS, Guard and reserve members are called upon to serve our nation throughout the world including the current peace keeping efforts in Bosnia and the war against terrorism, with the current focus being in Afghanistan and Iraq; WHEREAS, it is in the best interests of the citizens of Plymouth to support the participation of our employees in the Minnesota National Guard or as a member of a reserve component of the armed forces; and WHEREAS, those individuals who are called to active duty face personal hardship and sacrifice for our benefit; and WHEREAS, the payment of a salary differential will serve to reduce that hardship and encourage both service in time of need and a return to their duties as employees of the City. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the policy of the City of Plymouth will be the payment to each eligible member of the reserve components of the armed forces of the United States or members of the Minnesota National Guard an amount equal to the difference between the member's total active duty military pay including hazard, specialty and any other additional pay and the base salary the member would be paid as an active employee of the City, including any adjustments the member would have received if not on a leave of absence. This payment may be made only to a person whose basic active duty military salary is less than the salary the person would be paid as an active City employee. Payments will be made subject to the guidelines developed by the City. Payments will be made at the intervals at which the member received pay as a City employee. Such payments will be made only as authorized by law. Resolution No. 2003-192 Page 2 An eligible member of the reserve components of the armed forces of the United States or of the Minnesota National Guard is a reservist or national guard member who was an employee of the City at the time the member was ordered to active service. The term "active service" has the meaning given in Minnesota Statutes Section 190.05, subdivision 5, but excludes service performed exclusively for purposes of (1) basic combat training, advanced individual training, annual training, and periodic inactive duty training; and (2) special training periodically made available to reserve members; and (3) service performed in accordance with section 190.08, subdivision 3.
