APPROVING CONDITIONAL USE PERMITS FOR STONEWOOD
DESIGNBUILD LLC. TO ALLOW CONSTRUCTION OF 1) A SINGLE-
FAMILY HOME ON PROPERTY THAT DOES NOT HAVE ACCESS TO A
CITY STREET AND 2) AN ATTACHED GARAGE IN EXCESS OF 1,000
SQUARE FEET FOR PROPERTY LOCATED AT 235 BLACK OAKS LANE

WHEREAS, Stonewood Design/Build, LLC. has requested conditional use permits to
allow construction of a single-family home on property that does not have access to a city
street and a 1,900 square foot attached garage on property legally described as follows:
That part of Government Lot 8, in Section 32, Township 118 North, Range 22
West of the 5th principal meridian described as follows:
Commencing at a point in the south line of said Government Lot 8, distant 928.48
feet sest of the southeast corner of said lot; thence north 0 degrees 6 minutes west
1060 feet to the actual point of beginning of the tract of land to be described;
thence east parallel with the south line of said Government Lot 8, a distance of
214.9 feet thence north 0 degrees 52 minutes east 19.8 feet; thence north 13
degrees 01 minutes west to the north line of said Government Lot 8; thence west
along the north line to the shore of Gleasons Lake; thence southerly along the
shore of said Gleasons Lake to its intersection with a line drawn westerly from the
actual point of beginning and parallel with the south line of said Government Lot
8; thence east parallel with the south line of said Government Lot 8, a distance of
18 1. 1 feet, more ofr less, to the actual point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing, and recommends approval.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Stonewood Design/Build, LLC. for conditional use permits, subject to the
following conditions:
1. Conditional use permits are approved to allow 1) a single-family home on property
that does not have access to a City street and 2) a 1,900 square foot attached garage,
as shown on the application and plans received on March 12 and 17, 2003, except as
may be amended by this resolution.
2. A building permit is required prior to the commencement of construction.
3. Prior to building permit issuance, the applicant shall submit a wetland report and shall
have the boundary delineation, completed during the winter, verified during the
growing season.
4. Prior to building permit issuance, the applicant shall submit 1) plans for a private septic
system, including an alternative drainfield site and 2) a copy of the application for a
private septic system from Hennepin County Environmental Services.
5. Prior to building permit issuance, the applicant shall submit plans that expand the
pavement between the garage entrance and the circular driveway to facilitate fire truck
access to the property. A 15 -foot cleared access route up the driveway shall also be
provided. The applicant is further encouraged to incorporate a fire sprinkler system
into the house design.
6. Prior to receiving a building permit, the patio shown on the plans must conform to the
78 -foot setback.
7. Prior to receiving a building permit, the applicant shall submit an erosion control plan
in conformance with Section 21665 of the Zoning Ordinance including, but not limited
to, describing the methods employed to expose the smallest amount of bare ground
possible for the least amount of time feasible; apply temporary ground cover during
construction and permanent vegetative ground cover provided soon after; and prevent
erosion and trap sediment.
8. The attached garage shall be used for the storage of personal belongings and
automobiles. The garage shall not be used for a home occupation or other business
related activities.

A. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
B. The permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
C. Prior to occupancy of the home, address signage in compliance with the Fire Code
shall be required at the driveway entrance on Black Oaks Lane.
D. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started construction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21015.07
of the Zoning Ordinance.
