HomeMy WebLinkAboutCity Council Resolution 2003-188CITY OF PLYMOUTH RESOLUTION 2003-188 APPROVING PUD GENERAL PLAN FOR GEM ENTERPRISES FOR PROPERTY LOCATED AT 11255 HIGHWAY 55.(2003015) WHEREAS, GEM Enterprises has requested approval of a PUD general plan for property legally described as follows; PARCEL 1: The easterly 100 feet; front and rear, of the following described land, to wit: Commencing at the Southwest corner of the Southeast quarter of Northeast quarter of Section 35, Township 118, Range 22, thence North along the West line of said Southeast quarter of Northeast quarter said section a distance of 805 feet thence East along a line parallel with south line of said Southeast quarter of Northeast quarter a distance of 380.3 feet for a point of beginning; thence East along continuation of last course 422.9 feet, thence Northeasterly along a line which forms an angle of 81 degrees 49 minutes to the left a distance of 146.1 feet to a point in the Southerly right of way of the County Road, thence Northwesterly along said Southerly right of way line a distance of 360.8 feet, thence Southwesterly 258.7 feet, more or less, to point of beginning. PARCEL 2: Tract A REGISTERED LAND SURVEY NO. 1676, Hennepin County, Minnesota, Being registered land as is evidenced by Certificate of Title 83 105 1. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. Resolution 2003-188 File No. 2003015 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Gem Enterprises for a PUD general plan, subject to the following conditions: 1. The planned unit development (PUD) general plan to allow additional uses into an existing shopping center is approved, according to the plans received by the City on February 19, 2003, except as amended by this resolution. 2. Approval of the PUD general plan is contingent upon City Council approval of the requested rezoning. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. Development standards for the PUD shall be as specified in C-2 zoning district. The current shopping center building is legally non -conforming and shall be allowed to continue in accordance with the requirements of Section 21100 (Non -conforming Buildings, Structures, Uses and Lots) of the Zoning Ordinance. 5. As no construction is proposed as part of this PUD General Plan, no PUD Final Plan shall be required. Any subsequent modifications proposed, other than those considered interior tenant finishes or normal repair and maintenance, shall require amendment of the Planned Unit Development General Plan. 6. All signs shall conform to Section 21155 of the Zoning Ordinance. 7. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. c. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. d. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. Adopted by the City Council on April 22, 2003.
