HomeMy WebLinkAboutCity Council Resolution 2003-187CITY OF PLYMOUTH RESOLUTION 2003-187 APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY LOCATED AT 11255 HIGHWAY 55 (2003015) WHEREAS, GEM Enterprises has requested reclassification of the zoning from C-2 (Neighborhood Commercial) to PUD (Planned Unit Development) for 6.5 acres of land located south at 11255 Highway 55, legally described as follows: PARCEL 1: The easterly 100 feet; front and rear, of the following described land, to wit: Commencing at the Southwest corner of the Southeast quarter of Northeast quarter of Section 35, Township 118, Range 22, thence North along the West line of said Southeast quarter of Northeast quarter said section a distance of 805 feet thence East along a line parallel with south line of said Southeast quarter of Northeast quarter a distance of 380.3 feet for a point of beginning; thence East along continuation of last course 422.9 feet, thence Northeasterly along a line which forms an angle of 81 degrees 49 minutes to the left a distance of 146.1 feet to a point in the Southerly right of way of the County Road, thence Northwesterly along said Southerly right of way line a distance of 360.8 feet, thence Southwesterly 258.7 feet, more or less, to point of beginning. PARCEL 2: Tract A REGISTERED LAND SURVEY NO. 1676, Hennepin County, Minnesota, Being registered land as is evidenced by Certificate of Title 83 105 1. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and Resolution 2003-187 (2003015) Page 2 WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from C-2 (Neighborhood Commercial) to PUD (Planned Unit Development). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from C-2 (Neighborhood Commercial) to PUD (Planned Unit Development) for the 6.5 -acres of land located at 11255 Highway 55, based on the following findings: 1. The action would be consistent with the Comprehensive Plan. 2. The action would allow the applicant greater flexibility in marketing the site, but would not result in the intensification of the use on the site or exacerbation of the problematic access to and from the subject parcel. 3. The action would allow the applicant greater flexibility in marketing the site, but would not result in the intensification of the negative impact on the adjacent properties caused by the lack of adequate transition or buffer between the commercial property and the residential properties. 4. There is adequate infrastructure available to service the proposed property in its current state. ADOPTED by the City Council on April 22, 2003. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
