HomeMy WebLinkAboutCity Council Resolution 2003-156CITY OF PLYMOUTH RESOLUTION NO. 2003-156 AUTHORIZING THE VACATION OF 6TH AVENUE NORTH IN WOOD POINTE ESTATES WHEREAS, a petition was received to vacate 6th Avenue North in Wood Pointe Estates; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for March 25, 2003 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of March 25, 2003; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on March 25, 2003 to inform any and all interested parties relevant to the vacation of 6th Avenue North street right-of-way in Wood Pointe Estates; and WHEREAS, it was determined by the City Council that said right-of-way easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following street right-of-way be vacated: Resolution No. 2003-156 Page 2 All of 6th Avenue North, as dedicated in the plat of Wood Pointe Estates, according to the recorded plat thereof and situate in Hennepin County, Minnesota. FURTHER, a drainage and utility easement shall be retained over all of vacated 6th Avenue North. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
