HomeMy WebLinkAboutCity Council Resolution 2003-151CITY OF PLYMOUTH RESOLUTION NO. 2003-151 AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN THE EASEMENT ACQUISITION OFFER FROM METROPOLITAN COUNCIL ENVIRONMENT SERVICES (MCES) FOR THE PURCHASE OF A PERMANENT SANITARY SEWER EASEMENT AND TEMPORARY CONSTRUCTION EASEMENT ALONG 54TH AVENUE IN SECTION 7 FOR THE MEDINA LEG OF THE ELM CREEK INTERCEPTOR PROJECT MCES PARCEL NUMBER 13A MCES PROJECT NO. 900420 WHEREAS, the Elm Creek Sanitary Sewer Interceptor project has been designed, approved for construction and a contract awarded to Lametti and Sons, Inc.; and WHEREAS, the design of the project has a sanitary sewer pipe running along the South portion of 54th Avenue also known as parcel 13A; and WHEREAS, a portion of 54th Avenue between Ranier Lane and Peony Lane will be removed and replaced in-kind by the contractor after school is out this summer over a period of approximately three weeks; and WHEREAS, an offer has been made to the City of Plymouth from MCES to purchase the area needed to construct a sanitary sewer pipe within the right-of-way of 54th Avenue; and WHEREAS, the MCES has made an offer of $27,000 to the City of Plymouth for the permanent and temporary easements necessary to construct and maintain their interceptor sewer based on an appraisal performed by Orion Appraisals, Inc. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the Mayor and City Manager are authorized to sign and agree to the offer made by MCES for the easement rights within the right-of-way of 54th Avenue to construct the Medina Leg of the Elm Creek Interceptor Sewer. Adopted by the City Council on March 25, 2003. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
