RESOLUTION 2003-137
APPROVING FINDINGS OF FACT FOR ZONING ORDINANCE TEXT
AMENDMENT TO ALLOW TWO MENU BOARDS WITH A PERMITTED DRIVE-
THROUGH RESTAURANT (2003007)
WHEREAS, the Planning Commission has reviewed the text amendment at a duly called
Public Hearing; and
WHEREAS, the City Council has adopted a Zoning Ordinance text amendment to allow
two menu boards with a permitted drive-through restaurant.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a
Zoning Ordinance text amendment to allow two menu boards with a permitted drive-
through restaurant, based upon the following findings:
The proposed action would comply with the purpose and intent of the City's
Comprehensive Plan. The amendment would apply to permitted drive-through
restaurants, which are allowed as conditional uses in the C-3 (Highway Commercial)
zoning district. The Comprehensive Plan identifies the purpose of the Highway
Commercial district as to provide for services and limited retail primarily oriented
toward the motorist and requiring high volumes of traffic. The proposed Ordinance
would be consistent with this purpose by increasing the efficiency of permitted drive-
through restaurants. The proposed amendment would not have any affect on public
facilities or capital improvement plans.
2. The proposed amendment meets the purpose and intent of the Zoning Ordinance. The
amendment would be consistent with the C-3 (Highway Commercial) zoning district,
which allows drive-through restaurants with a conditional use permit. Staff finds that
the amendment to allow a second menu board would increase efficiency of operation
of permitted drive-through restaurants.

3. There would be no unusual infrastructure needs associated with the proposed change
to the Ordinance.
4. The proposed amendment would not be incompatible with surrounding uses. The
limited size of the menu boards and location within the drive-through would not
negatively impact surrounding districts.
