HomeMy WebLinkAboutCity Council Resolution 2003-109CITY OF PLYMOUTH RESOLUTION 2003-109 APPROVING A CONDITIONAL USE PERMIT FOR HOWARD AND JULIE TRIPP TO ALLOW A DETACHED GARAGE OVER 1,000 SQUARE FEET ON PROPERTY LOCATED AT 5650 JUNEAU LANE. (2002153) WHEREAS, Howard and Julie Tripp have requested a conditional use permit to allow a 1,944 -square foot detached garage on property legally described as follows: That part of Government Lot 1, Section 4, Township 118, Range 22, described as follows: Beginning at the intersection of the west line of said Government Lot 1, with the South line of the north 600.00 feet of said Government Lot 1; thence easterly along the south line of said north 600.00 feet a distance of 300.00 feet; thence southerly and parallel with the west line of said Government Lot 1, to the shoreline of Pomerleau Lake; thence southwesterly along said shoreline to the west line of said Government Lot 1; thence northerly along said west line to the point of beginning, according to the U.S. Government Survey thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Howard and Julie Tripp for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow a 1,944 square foot garage, as shown on the application and plans received on February 11, 2003, except as may be amended by this resolution. Resolution 2003-109 (2002153) Page 2 2. The detached garage shall be used for the storage of personal belongings and automobiles. The garage shall not be used for a home occupation or other business related activities. 3. Prior to the issuance of a building permit, the plans shall be revised to demonstrate a minimum of 20 feet between the location of the detached garage and the septic system's drainfield as required by the Minnesota State Rules (7080). 4. The location of the drainfield shall be located and flagged prior to commencement of construction. 5. Prior to issuance of a building permit, the applicant shall submit elevations for the building which are compatible with the home and are residential in character. 6. A building permit is required prior to the commencement of construction. 7. Prior to footings inspection, the property irons on the east side of the property shall be exposed, staked and connected by a string to confirm setbacks. 8. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
