HomeMy WebLinkAboutCity Council Resolution 2003-105CITY OF PLYMOUTH RESOLUTION 2003-105 APPROVING PRELIMINARY AND FINAL PLAT FOR MARK MCFARLAND, FOR "WOODVIEW HEIGHTS", FOR PROPERTY LOCATED AT 4525 ZACHARY LANE (2002150) WHEREAS, Mark McFarland has requested approval of a preliminary and final plat for 2 single family lots on a 1.4 -acre site located at 4525 Zachary Lane; and WHEREAS, the property is legally described as: Outlot `B" Tepley Addition, Hennepin County, MN WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mark McFarland for approval of a preliminary and final plat for 2 lots on a 1.4 -acre site located at 4525 Zachary Lane, subject to the following conditions: 1. The preliminary and final plat is approved in accordance with the plans received by the City on November 26, 2002 and December 6, 2002, except as amended by this Resolution. 2. The applicant shall comply with the tree preservation regulations outlined in the City Code. 3. The existing driveway connection to Zachary may remain. No direct access shall be allowed to Zachary Lane for Lot 2. 4. Prior to recording the final plat, a 10 -foot trail easement over the existing trail shall be required on the east side of Lot 2 adjacent to the Zachary Lane right-of-way. Proof of recording shall be required prior to the issuance of building permits. Resolution 2003-105 (2002150) Page 2 5. Prior to recording the final plat with Hennepin County, a deed for a trail outlot between Arrowood Lane and Zachary Lane shall be given to the City. 6. Prior to recording the final plat with Hennepin County, the final plat shall be revised to reflect the trail outlot located along the north lot line of Lot 1. The applicant shall be compensated for any value over that required as park dedication. 7. Setbacks shall be as required for the RSF-2 district. No variances are approved or implied. 8. A building permit shall be required for the construction of the home on Lot 2. 9. The existing trail along Zachary Lane shall not be used for construction access or storage. Any damage done to the trail must be repaired by the developer. 10. Notice of the future trail connecting Arrowood Lane and Zachary Lane shall be included in the sales documents so that potential buyers will be aware of the trail plans for this location. 11. Standard Conditions: a. Compliance with the City Engineer's Memorandum. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new structures on sites adjacent to, or containing any open storm water drainage facility. d. No building permits shall be issued until the final plat is filed and recorded with Hennepin County and proof of recording is received by the City.
