HomeMy WebLinkAboutCity Council Resolution 2003-064CITY OF PLYMOUTH RESOLUTION NO. 2003-064 AUTHORIZING THE VACATION OF PART OF A PERMANENT EASEMENT FOR PUBLIC UTILITY PURPOSES AND A TEMPORARY EASEMENT IN THE SOUTH 127.50 FEET OF LOT 16 WAYZATA FARMSTEADS WHEREAS, a petition was received to vacate part of a permanent easement for public utility purposes and a temporary easement in the south 127.50 feet of Lot 16, Wayzata Farmsteads; and WHEREAS, said petition was signed by a majority of the owners of the land abutting the area proposed to be vacated; and WHEREAS, a public hearing with respect to said vacation was scheduled for January 28, 2003 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of January 28, 2003; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on January 28, 2003 to inform any and all interested parties relevant to the vacation of part of a permanent easement for public utility purposes and a temporary easement in the south 127.50 feet of Lot 16, Wayzata Farmsteads; and WHEREAS, it was determined by the City Council that said easement was not needed for public purposes; Resolution No. 2003-064 Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following permanent easement for public utility purposes and a temporary easement be vacated: Description of Parcel: The south 125.70 feet of Lot 16, "Wayzata Farmsteads," according to the recorded plat thereof, Hennepin County, Minnesota, as measured at right angles to and parallel with the south line of said Lot 16. Easement to be Vacated: That particular 20.00 foot public utility easement as granted in Document No. 5056992 and described as follows: A permanent easement, 20 feet in width for public utility purposes and a temporary easement, 100 feet in width for construction purposes, over, under, across, and through part of the above described parcel, the centerline of both which is described as follows: Commencing at the southeast corner of said Lot 16, thence westerly along the south line of said Lot 16 a distance of 304.50 feet, thence deflecting northerly to right 90 degrees 00 minutes 00 seconds, a distance of 125.70 feet, thence northwesterly to a point of the west line of said Lot 16, distant 250.70 feet North of the southwest corner of said Lot 16, and said centerline there terminating.
