HomeMy WebLinkAboutCity Council Resolution 2003-047CITY OF PLYMOUTH RESOLUTION 2003-047 APPROVING A CONDITIONAL USE PERMIT FOR PILLAR HOMES TO ALLOW ACCESSORY LIVING QUARTERS ON PROPERTY LOCATED ON THE SOUTHERNMOST LOT ON FUTURE SHADYVIEW LANE SOUTH OF 8TH AVENUE NORTH. (2002158) WHEREAS, Pillar Homes has requested a conditional use permit to allow accessory living quarters on property legally described as follows: Lot 5, Block 1, Serenity on Hadley Lake, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pillar Homes for a conditional use permit, subject to the following conditions: 1. A conditional use permit is approved to allow accessory living quarters, as shown on the application and plans received on December 13, 2002, except as may be amended by this resolution. 2. The accessory living quarters shall not be rented as a separate dwelling unit. 3. A building permit is required prior to the commencement of construction. 4. Prior to building permit issuance, the applicant shall submit plans that include either 1) a turn -around area, in compliance with Fire Department policy and City Code, or 2) an Resolution 2003-047 (2002158) Page 2 of 2 automatic fire sprinkler system pursuant to City policy. Any turn -around must comply with design, width, turning radius, and vertical clearance requirements. 5. Prior to building permit issuance, the survey shall be modified to include the correct elevation for the 100 -year flood plain. 6. Prior to building permit issuance, the survey shall be modified to document the location of tree preservation fencing and compliance with the tree preservation plan. 7. Standard Conditions: A. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. B. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. C. Prior to occupancy of the home, an 8'/2 inch by 11 inch as -built fire protection plan and building data sheet are required if the building is sprinklered. D. Prior to occupancy of the home, address signage in compliance with the Fire Code shall be required at the driveway entrance on Shadyview Lane. E. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 21015.07 of the Zoning Ordinance.
