HomeMy WebLinkAboutCity Council Resolution 2003-045CITY OF PLYMOUTH RESOLUTION 2003-045 APPROVING A PUD (PLANNED UNIT DEVELOPMENT) GENERAL PLAN AMENDMENT AND LOT DIVISION TO SUBDIVIDE AN EXISTING LOT INTO TWO PARCELS FOR THE DEVELOPMENT OF TWO RESTAURANT BUILDINGS AT THE NORTHEAST CORNER OF STATE HIGHWAY 55 AND NORTHWEST BOULEVARD (2002152) WHEREAS, Frauenshuh Companies has requested a PUD (Planned Unit Development) General Plan Amendment and Lot Division for the 2.66 -acre lot located at the northeast corner of State Highway 55 and Northwest Boulevard; and WHEREAS, the existing lot arrangement for the subject property is legally described on Attachment One, attached hereto and hereby made a part hereof, and WHEREAS, the proposed lot arrangement for the subject property is legally described on Attachment Two, attached hereto and hereby made a part hereof, and WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve this request of Frauenshuh Companies, subject to the following conditions: 1. A PUD general plan amendment and lot division is approved to allow subdivision of an existing 2.66 -acre lot (Lot 4, Block 1, Northwest Business Campus 14th Addition) into two parcels for the development of two restaurant buildings, in accordance with the plans received by the City on December 24, 2002, except as amended by this resolution. 2. Except for the physical lot arrangement and square footage of restaurant space assigned to Lot 4, Block 1, Northwest Business Campus 14th Addition, this PUD amendment shall comply with all of the standards and conditions of the PUD amendment adopted on February 5, 1997, per City Council Resolution 97-78. The 1997 PUD amendment approved one restaurant building containing 12,000 square feet on the subject lot (Lot 4, Block 1, Northwest Business Campus 14th Addition). This PUD amendment allows subdivision of the subject lot into two separate parcels, with a 7,300 square foot restaurant on Parcel A (the westernmost parcel) and a 3,800 square foot restaurant on Parcel B. 4. Prior to issuance of the building permit for each parcel, the landowner shall obtain separate approval of a PUD final plan for the respective restaurant building. 5. Prior to recording the lot division with Hennepin County, cross easements for access, parking, and utilities for Parcels A and B shall be submitted for approval by the City Engineer. Such easements shall subsequently be recorded with the lot division. 6. This resolution allows on -sale liquor accessory to the restaurants planned for Parcel A (the westernmost parcel) and Parcel B (the easternmost parcel), provided prior approval of the required liquor license is granted by the City Council. 7. Prior to issuance of the building permit for each of the two proposed parcels, payment of the park dedication fee in lieu of land dedication must be paid, based on the dedication ordinance in effect at the time the building permit is applied for. 8. The locations of the fire hydrants, post -indicator valves, fire department connections, and fire lane signage must be approved by the Fire Inspector. 9. Site drainage must be coordinated between the two proposed parcels. 10. With respect to the exterior building elevations for the planned Red Robin Restaurant on Parcel A, the architectural details and color scheme shall be finalized with the PUD final plan. The building materials will be required to match the existing building materials used in the adjacent commercial portion of this PUD. Additionally, the horizontal banding features on the columns shall be the same color as the columns, unless otherwise approved during review of the PUD final plan. 11. The minimum building setbacks from interior side lot lines shall be pursuant to the plan submitted on December 24, 2002, for the buildings on Parcels A and B. Resolution 2003-045 (2002152) Page 5 of 5 ATTACHMENT TWO (Proposed Legal Descriptions) PARCEL A (westernmost parcel): That part of Lot 4, Block 1, NORTHWEST BUSINESS CAMPUS 14TH ADDITION, according to the recorded plat, Hennepin County, Minnesota, lying northwesterly of a line described as follows and its extension: Commencing at the northwest corner of said Lot 4; thence on an assumed bearing of South 59 degrees 34 minutes 00 seconds East, along the north line of said Lot 4, a distance of 187.64 feet to the point of beginning of the line to be described; thence South 30 degrees 26 minutes 00 seconds West, a distance of 348.00 feet to the south line of said Lot 4, and said line there terminating. PARCEL B (easternmost parcel): That part of Lot 4, Block 1, NORTHWEST BUSINESS CAMPUS 14TH ADDITION, according to the recorded plat, Hennepin County, Minnesota, lying southeasterly of the line described as follows: Commencing at the northwest corner of said Lot 4; thence on an assumed bearing of South 59 degrees 34 minutes 00 seconds East, along the north line of said Lot 4, a distance of 187.64 feet to the point of beginning of the line to be described; thence South 30 degrees 26 minutes 00 seconds West, a distance of 348.00 feet to the south line of said Lot 4, and said line there terminating.
