HomeMy WebLinkAboutCity Council Resolution 2003-044CITY OF PLYMOUTH RESOLUTION 2003-044 APPROVING SITE PLAN, CONDITIONAL USE PERMIT, AND FIRE LANE VARIANCE FOR TWO OFFICE BUILDINGS TO BE CONSTRUCTED AT THE SOUTHWEST CORNER OF 37TH AVENUE AND PLYMOUTH BOULEVARD. (200213 1) WHEREAS, Bakken Properties, LLC has requested a Site Plan, Conditional Use Permit, and Fire Lane Variance for two office buildings to be constructed at the southwest corner of 37H` Avenue and Plymouth Boulevard, for property legally described as: The east 252.20 feet of Lot 1, Block 2, Plymouth Hills, Hennepin County, MN WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Bakken Properties, LLC for a Site Plan, Conditional Use Permit, and Fire Lane Variance for two office buildings to be constructed at the southwest corner of 37t` Avenue and Plymouth Boulevard, subject to the following conditions: 1. A site plan, conditional use permit, and fire lane variance is approved to allow construction of two 12,500 square foot buildings, in accordance with the plans received by the City on October 9, 2002 and December 11, 2002, except as amended by this resolution. 2. Prior to issuance of building permits, the applicant shall submit a revised lighting plan that meets the requirements of Section 21105.06 of the Zoning Ordinance. The lighting plan shall include fixture details for exterior wall -mounted light fixtures. Resolution 2003-044 File No. 2002131 Page 2 3. Prior to issuance of building permits, the applicant shall provide a financial guarantee and Site Improvement Performance Agreement for all site improvements. 4. Medical, chiropractic, dental offices, and clinic uses are not permitted on this site as there is not adequate parking for these uses. 5. The monument sign shall be installed at a 45 -degree angle as shown on the site plan and code review plan (A101), received by the City on December 11, 2002. 6. A sign permit is required for all signage. 7. All roof -top mechanical equipment shall be screened to meet the requirements of Section 21130.45 of the Zoning Ordinance. 8. A fire lane variance is approved for the area between the two buildings and for the south end of the southern -most building with the following conditions: a) Both buildings must be protected by a City approved automatic fire sprinkler system that is monitored by a City approved UL central station. b) Fire hydrants shall be installed in approved locations on the site. c) Fire flow calculations shall be approved by the Fire Inspector. d) A paved sidewalk shall be provided to each building as identified on the site plan. 24-.9. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. j -f This approval shall expire one year after the date of approval, unless the property owner* FFormatted, Bullets and Numbering or applicant has substantially started construction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07 and 21045.09 of the Zoning Ordinance.
