HomeMy WebLinkAboutCity Council Ordinance 2004-09CITY OF PLYMOUTH HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 2004-09 AN ORDINANCE AMENDING THE TEXT OF CHAPTER 21 OF THE PLYMOUTH CITY CODE, ENTITLED THE PLYMOUTH ZONING ORDINANCE (2004055) THE CITY COUNCIL OF THE CITY OF PLYMOUTH ORDAINS: SECTION 1. Amendment. The text of Section 21115.07 of the Plymouth City Code is hereby amended as follows: 21115.07. TWO FAMILY, TOWNHOUSE, MANOR HOME, MULTIPLE FAMILY USES: Subd.1. No single townhouse structure shall contain more than eight (8) dwelling units. Subd. 2. Subdivision of Two Family or Townhouse Lots. The subdivision of base lots containing two family dwellings, or townhouses, to permit individual private ownership of a single dwelling unit within such a structure may be allowed upon the approval by the City. Approval of a subdivision request is contingent on the following requirements: (a) Prior to a two family dwelling or townhouse subdivision, the base lot must meet all the requirements of the zoning district. (b) The lot area calculation for individually platted unit lots shall include the proportionate share of the surrounding base lot. (c) Permitted accessory uses as defined by the zoning districts are acceptable, provided they meet all the zoning requirements. (d) A property maintenance agreement must be arranged by the applicant and submitted to the City Attorney for review and comment. The agreement shall ensure the maintenance and upkeep of the structure and lots to meet minimum City standards. The agreement is to be filed with the Hennepin County Recorder's Office as a deed restriction against the title of each unit lot. (e) Separate public utility service shall be provided to each subdivided unit and shall be subject to the review and approval of the Zoning Administrator. units: (f) The subdivision is to be platted and recorded in conformance to the requirements of the Subdivision Ordinance of the City. (g) Minimum unit lot width for townhouses shall be not less than twenty (20) feet. (h) Requirements of the Minnesota State Building Code at the time of subdivision shall be complied with. Subd. 3. Subdivision of apartment dwelling structures, manor homes and other such (a) The subdivision is to be platted and recorded in conformance with the requirements of the Subdivision Ordinance of the City, as applicable. (b) The subdivision shall comply with applicable cooperative or condominium laws of the State of Minnesota. SECTION 2. Effective Date.
