stated he had ,contacted the developer of "Woodlands" and
they stated they were .coming to this meeting t(7 talk about
the feasibility, of an exchange of the outlotse He stated he
was aware of the recommendation for Cutlet E Woodlands, but
was not awware of Cutlot A until he received the staff
report.
Chairman tei er ald opened the Public Hearing*
Sandy Ritter, 120 1st Ave, stated he is a representative for
the Woodlands development. He was not prepared'to say that
an exchange of outlets would be., fear, b,le as he had not had
the opportunity to look into the situation until recently.
He stated that can the surface it is logical and he doesn't.
see any major concerns, however, he does have a concern re
garding the setbacks to 45th Avenue North.

Or. Ritter stated that he Would like, to know the transition
of the single family dwellings from the 4-plexes, on the
south. He stated he recognizes the density is appropriate

north; Coordinator MeConn explained the proposed setback to

Mr. Ritter stated he does not object to the four-ple build-

Company.
Chairman Steigerwald closed the Public Hearing.

answered affirmatively, and explained that he couldn't

Use Pe mit., Site Plan, and Variance for "Hamm- BergAddition"
subject to the conditions as stated in the Novmber 7,, 1985
staff report.
Commissioner Pauba stated he is concerned about the number
of variances, that he does not oppose the project but would
like to see this development combined with the land to the
east. Commissioner Stulberq stated he understands Commis-
sioner Pauba's concern. However, it appears that develop-
ment of this remnant parcel is dependent upon the variances
as requested; and, the development does. tie in with the
area Commissioner Pauba agreed the parcel is 'difficult to
work with.

Chair man ei erwaldstated that an allowance should be

for the development.. He stated this takes care, of the
practical concerns such as snow storage areas. rmi. sio er
fel. fka agreed that the number of variances Is high, but be-
cause of the topography and additional nermi:ngt the requests
aro reasoaahlc. He stated concern with the selection of
Summit Ash as a planti.nq noting this is a light, airy tree
which may not afford adequate screening.
Coordinator McConn stated: that with other app-, - oat -ions the
City Council and Planning Commission have considered reduo-
tion of yard areas and have required additional Landscaping
to mitigate this situation. comm:%ssionor p ufka stated that
the Ash would not provide a year round scrkeening and he
would like to see conifers along 45th Avenue# He stated it
is not necessary to have ars impervious screen,. but this
would break-up the sight lines between the single family arid
multi. -family units.

Chairman Stie1qerwald seed. the "key" for one sheet shows
the symbol for 411 Maples, however, they do not appear on the
landscape plan. He inquired where they would be located,.
Mr. * Hamm stated that when this pian was submitted it was not
acceptable to staff and he submitted a revised plan.Co-
ordinator RoConn confirmed that the first pla did not meet
the Landscape Policy requirements and was revised. She
stated there were no conifer plantings provided and the
Policy requires a certain number of conifer and deciduous
trees«
Commissioner Stulberg stated that even'6 ft. Evergreens may
not be to diminish the v Dual impact because of the

aloner Plufka stated he is not looking for tonal screening
but would .like to see a plan that will break up the vis€.al

Commissioner Stulbery stated that as,there will be plantings
around` the buildings to soften the corners, direction could
be given to staff regarding the final ,landscape plan for
additional shrubbery and under -story plantings.

Chairman Stelgerwald Introduced Tom Loucks* Team Loucks
Associates, representing ,,the petitioner,. fir. Loucks stated
they will comply with the landscaping requirements and that
Lot , Block 31 will be adjusted to meet the minimum stand-
arms as directed by staff.
Chairman Steigerwald opened they Public Hear nq.
David Peterson,, 524£ Cottonwood lane, stated he has no
objections to this development but is hopeful they will be
as careful in developing this land, such a's the maintenance
of existing gees:, as was acne with the Harrison Halls
project.
Brad Phipps, 5309 Umanes bane, stated he lives adjacent to
the proposed development and he echoes the concern: on re-
taining the trees, especially 'those that exist as a separ-
ation between this development and Harrison Hills. He in-
quired about the transition to the single family residential
area.
fir. Loucks stated their plan axes into the Harrison Hills
development and he pointed aut the existing vegetation that
will be retained where they will supplement with additional
landscaping. He stated they propose to move existing over
story trees:' to other areas of the development where
practical.
Hr. Phipps stared there has been clot of construction occur-
ring In this area which has been on-going for many years.
He stated the roadways have been damaged ,and construction
debris as prevalent.. He also inquired, whether berming, such
as pro=vided from Harrison Hills to the railroad track, will
be provided with this development.

Mr. Phipps reiterated the dam qe to roadways by heavy con-
struction equipment and he inquired how the City controls
the maintenance of reads during construction. City Engineer
Goldberg explained that the developer is banded for the oon-
truction of streets* and,, that financial guarantees are
provided for site work and erosion control which includes
street 'clears -Ing He agreed that there are some roads which
Nve e repaired artd have now resettled, and need additional
work. Coordinator McGonn explained that development and
cdnstroction within Harrison Hills began prior to the City's
establishing the Erosion Control Policy.
Mr Phipps inquired when the repair work an(A or street
cleaning would be called for by the City. Coordinator
h cGonn _expl' ;ned that this is done when ever it is needed,
that the City has a cash deposit From the developer so the
City can contract to have the work done.` City Engineer
Goldberg stated the City requires the developer to have a
Ask contract 'with a street sweeping company. Mr. Phipps inquir-
ed about roadways that are used by the construction vehicles
but are not around or within a new development. City
Engineer Goldberg a suied that all areas showing construe -
tion debris on the roadways would be ` cleaned. her. Phipps
stated it is his opinion that the Ordinance is in dguate,
He, inquired about the outlots, In this development. Mr.
Loucks explained the out lot that is proposed because sever
is not available; anal the out -Jot designated for common open
space for the residents of the development.'
Mr. Phipps .reiterated his concern about the length of time,
ItI has, taken to complete construction in this ,area. He n-
quireid if the City would designate a time -frame An which
construction is to be completed. Chairman Steiger ald ex-
plained there is no City Ordinance that calls for a time-
frame for construction. Coordinator MeConn explained that
Development Contracts and Financial Cuaran ees for develop -
tent; cons ructiony and,, site improvements. provide that all
work will be completed. However, a time frame for build -rout
is not established.
Mr. Phipps < stated there should be an Ordinance to protect
adjacent homeowners., 0 twissioner Pluf a stated he has
found that the financial guarantees and contracts posted
with the City have provided a marked improvement in the
0 clean-up of constriction debris and timely completion of
site improvements and he has noted this in his own
neighborhood,

that traffic coming from the proposed development will
impact themr homes because of headlight glare. Mr. Keiser
stated the drawings are inaccurate with respect to the loea-
tion of the existing driveways. Coordinator McConn res
pended that., a review of the original Harrison Hills plans
will be necessary to check the ;location of the existing
dt iveways and determine if they were constructed as
approved.
1r. David Peterson stated these drives are _temporary because
at the time of development he was unable to contact ;the
owner of the property now proposed for development to dis-
cuss the extension of 53rd Avenue.
Coordinator MoConn responded. to Mr. Keiser#s concern about
headlight gilare and 'advised there are no plans for addition-
al .landscapinn for the Harrison ells development.
Chairman S eigerwald stated that impacts from the extension
of 53rd Avenue North will be considered by staff and tile
develop
1r. Keiser inquired about the 'dansxlty for this development
and If the development of multi. -family' buildings will affect
the property valu6s, of the, singe family residences. Mr.
1 oueks stated that the density is higher in Harrison Hills
than ghat is proposed for this development.
Coc,,rdinator McConn explained the density for the proposed
development is within the LA- (low medium density resi-
dential) Guide Flan designation,
Mr, Loucks, explained the futurx development plans and the
constraints on further d vel. pmen#t of ,this area.
it-jr. Keiser stated his concern „hat the density for thi
development is misleading. Coordinator UoConn explained
that the Ordinance allows 26 townhouse units and this pro-
posal cabs for 24 townhouse units. Chairman Stoi,gerwald
stated the development plan is, consistent with development
n the surrounding ar*ear.. Mr., Keiser inquired about the
prices.for;these homes, Chairman Stelgerwald explained that
the developer is not required to guarantee the prices of the
homes to be constru,.ted. 3r. Loucks stated the proposed
style of the homes wit fit into the surrounding
neighborhoods.

freeway.. ear. Lair stated this is a valid concern, however
this property is at least a quarter mile from 1-494.
