addressed those concerns expressed at the public ,Hearing
held on September ll, 19,,,15. Their drainage plans have been
reviewed by the Bassett Creek Watershed District and the
Department of N t ral Resources WNR); they will angle the
light standards and building lights downward to lessen the
impact of glare into the nelc hbor nq areas; and, the audio
for the loud speakers wi 1, l be degreased. lair. Wonson stated

They plan to install a sign on 13th Avenues for traffic dir-

ick Andersen, 10530 South Share Drive, stated he Is pleased
with the progress made in resolving some of the concerns.
He. is in agreement= that the fabric can the fence should be ,
o:atted as it will get darty and sagged. lir. Jonson stated:
they would use sheets of the fabrlot but he concurs that
after time it would wear out.
Mr. Andersen inquired about the proposers use of the land
owned by the Auction at the south ead, of 13th Avenue. Mr.
Danson stated they have not Included any plans for this site
as the City advised them of the importance of the work on
the Auction and Oak -mar sates. He stated they ,could use it
for parking, but could only fit approximately 70 spaces on
the site which would not meet their needs.
Mr. Anderson stated he would prefer that all the parking:
areas be out of view, from the residential neighborhood.
Mr. Wonson' stated that the Oaloiar site is out of the sight
line of the neighbors. '4r., Anderson inquired about : any
continued problems with the lighting or the loud speakers.
Chairman Steigerwald stated the City ;should be notified of
any problems re ardi.nq these sites. The Conditional Use
Permit is reviewed on an annual basis and if they do not
comply with the conditions of approval, the Permit can be
revs ed c tti a recommendation for revocation.

stated at this time there are 3 to 4 trucks da *k however,
lie cannot conceive that this produces much noise. He stated
he has monitored the site, and as an example today there w,ls
a large sale and they site was cleared by 7:00 P.M. He
stated he feels many of the concerns stem from years past;
and they are trying to eliminate and reduce as mare of these
problems as they can. lie noted they now have 6 truck bays
And this will move the truck traffic in and out A,Iuch faster.
Mr. Buzzeltel stated that the noise problemsare more pr va-
te nt in the summer months. Mr. Busch stat=ed they want to
know about the problems, but he does not agree that there
are severe problems now. He noted there are marry otter
commercial and industrial site$, such as Honeywell for
example, that contribute to the; heavy traffic, by the
md,ements of their employees at the beginning and end of the
business day
Mr. Buzzelte inquired if the creek is protected from run-
off. Mr. Wons n explained there will be settling, ponds to
protect the creek and they ponds Will be expanded. to moot the
requirements of the Watershed t)istrict and OMR.
Commissioner Plufkj inquired if the runoff would be on top,

Mr. Buz eYlle inquir d about snow removal and the salt and
oil residues* He Inquired if they Mould be throwing the
snow over the fence into the swamp. Mr. Wonsoh stated this
Would not he the ease, they would dispose of the snow b
hauling it dway or dumping on their ern property he noted
they could ` not get they plows thro0gh the trees on the gest
side to dump in the: swamp area*
Mr. Buzzelle stated his concern that South Shore Drive has
become a dangerous roadway,
Mr. Bots Scribner, 2015 Lancaster Lane, ,.. tated he had -taped
with Mr, Busch, they did not spend ,ttot of time but It has
been advantageous to have someone who will return telephone
calls, agrees to meet with the residents, and is concerned
about what is going on at his businessMr. Scribner stated

Chairman Steigerwald inquired if this project is on the

this is not listed at this time and that development to the

they encourage the Auction to close the site as close 'to
700 P.M. as possible on Auction day- however, it Is not the
Comnlission's role to dictate speciflo hours of operation.
Mr. Scribner added that he prefers the chain link fence to
what Is on raybow-Daniels' site. He would also like to see

important, but of even more importance is the upgrading of
10th Avenue. lie is concerned that this business is confined

stated the Planning Commission needs to stress tete upgrading
of 10th Avenue* and, it is his opinion that the City does
not deal with these problems early enough and that, as these
problems d vel.o t the City should hold public hearings to
resolve them.:

through the City to resolve any problems that may arise.
Mr* flusch stated he would -meet one-on-one with Mr. Scribner
o that he Can keep the AMLAC neighborshbors informed. He noted
that the hours of operation are not as much a oono--rn In the
winter months, but In the summer months at could be diffi-
cult if they are forced into certain hours; he suggested
they see how these improvements work next summer and have
disctissa.ons with the neighborhood groups at that time.
Commissioner Magnus suggested they remove the trailers.

the residents who attended the first meting about the
screening. ` Mr. Scribner stated he had discussed it with
AMLAC and with Dave Buzzelle, who discussed it with Ills
neighbors. Chairman Steigerwald Mated he does not want to
confuse the issues for "those who have had input into the
discussion of the application.

Commissioner Plufka noted his concern about the berm height
and that his review shows the berm at 3 ft.. on the south,
and 1/?- ft. on the east. Coordinator' McConn noted the
plans shoe a berm of 5' ft on the south and 3 ft, on the

berm be adequate to shield adjacent residential areas from
headlight glare,

two variances lncludlnq the request for the rotating sign,
noted the service station has been a part of this
neighborhood for 53 years and; that remodelinq and upgro;Jittq

granted, It would cause congestion on the site.
He explained the location of the signage. He stag -4t -ley
have no problem with preparing the legal documents- for the

Simonson stated they do not feel that the site is
over -built; and,, whcather or not approval is granted they
request the Commission riot recommend deferral but send the
application on to the City Council for their. consideration.
Chairman Steigerwald asked Irwin Kilstofte, Architect, to
address Commissioner Pl+fka#s questions regarding the berm
heights. t -r. . Ki;lstofte explained the drawingss are engineer -
Ing drawings rather than landscape plans and it is very cif
ficult to be exact, the height does vary from 3 to 6,ft« and
an adjustment will be made on the final Landscape documents.
Commissioner Plufkd reiterated his concern. thar, if tate berms
are below 3 ft.in height, there will b a problem with
headlight glare into ",;he residential area.
Elevations were discussed and Coordinator McConn noted that
the slopes must be maintained at 3 to I for 'erosion control,
Chairman Steinerwald stated that the City Forester has
advised that the life expectancy of ' the _ plantings may be
reduced if they ,aro planted too close together and that
there could be Problems fut=ire years. Coordinator McConn
expla ned that, the Norway Pine branches could die out as
they grow together .hash would defeat the purpose of the
screening. She stated the City Forester has suggested
planting Northern White Cedar an ,Arbor Vitae planted 6 to 7
ft. on center which will orow to 40 ft

Mr. Edwin Brunken, 17200, 14th Avenue North$ stated that the
comments made khat this development provides a necessary
community service is not true as it provides nothing that is
not close by and roddily available.

Commissioner Magnus inquired about Building A. fir. 3ohnson
explained it would be a combination of medical retail, and
office space. Commissioner Magnus stated concerns regarding
the hours of operation in the building -1, especially in the
case of the medical' service which would be available late
into the evening, ands that the building is so close to a
residential neighborhood.
Mr. 3ohnson explained that: the representatives for the media
cal facility are not preseitu tonight, and he would be unahlt
to answer specific questions about their practice.
Chairman Steigerwald, noted that the medical service is a
permitted use and hours of operation would riot be stipu-
lated,; Commissioner dellen stated that regulating the hours I
of operation wo,ild make it seem as ' though the City were
si.ngltiinq out this business from the shopping area and ser- !.
vice station* Commissioner Magnus maintained 'those facili-
ties will be awayfrom the residential area and that it
should be anticipated there will _' be noise from this bua ld-

allow the building to be used at all hours,
Mr, Brunken, stated the neighborhood suffers from the gash
accumulation from Kimberly Meadows for example, and that
over r ildipq this site will add to the debris, He also
rioted that ha.s car headlights are higher than i ft.. and
that the berms as presented are not acceptable. He stayed
his concern about the mistakes made with the screeninq of
Kimberly Meadows and he doesn't want to see the same pattern
c,stabl shed for this development. He stated he has no
objection to the medacal facility, but does not feel the
variances are warranty .
Commissioner Wire stated that each time the petitioner has
come hack with the proposalhe ,°nave maintained the size of
Building A. He stated they had made the case that it would

Cortmissioner Wire stated it t as his opinion that a smaller
bdildinq would not be unusual or unique and may only mean

not agree and stated there is a hardship if there is a need
to reduce ` the size of the bul lding Commissioner Wire
stated that Al variances are reviewed carefully n(x the
Commission and Council do not take these rtAuests lightly.
He stated the Ordinance standards should be maintained If at
all possible.
Mr. Simonson st'j, the fact that the right-of-way a

elopment, making it even more economically unfeasible. Re
stated he understands the Commissioners' concerns, but that
they must also see l ''rom the develowrls standpoint that
he should not be pc 0.i<=ed for dedicating the right-of-way.
Commissioner Wire explained that variances are "tot granted

variances, and decreasing the building size could r duco or

Commissioner Fllufka stated that the other; side' of the coin

tant to this development to 'handle Inerersed traffic. The
improvements to be made for Highway 101 and County Road
are needed

Commissioner Plufka inquired, if he thought a 9 x 6 sign
would really be visible alone 1-494, and noted that this
sign is shown parallel with only one face. lir. Pent con-
firmed the proposal is 'to hat the two -Faced sign perpendic-
ular to the freewi . Commissioner Hlufka stated the; sign Is
not large enough to be effective an j could create a traffic
hazard tlr". Pentz stated they did want a lat ger sign, how-
ever, their proposal was made; to stay dose within the pro-
visions of the Sign Code.

looking for these particular cenanr , or if the: tenant will
