Coordinator McConn reviewed the 1951 Approval by the City
Council for the Bo man Development Plan. She noted that
this petitioner has 'worked with the Department of Natural.
Resources (DNR)and the City Engineers to locate 29th Avenue
further to the northwest. She stated that DNR reported
there is illegal fill in the santhwest corner of the pond
whi.eh will be removed.
Jerry ffeI, 1OV5 31st. Avenue North., stated he would like
to review the NMR report to see the details of the plan,
Coordinator Mc Conn .explained that the current application
has been forwarded to DMR for their review and read the, et -
ter received from the Regional Waters Office., Appropriate
permits will: be required before road construction eould
begin.

viewing the development at the Final. Plat stage and that the
comments and input from those in attendance: Is important.
Mr. Coffet stated h shares the concerns regarding the pres-
ervation of the witalife and Inquired if the plan preserves
the water flow o that it will drain into the pond. He
asked about requirements for buildable lot.s as it is diffi-
wilt for him to see' how some of these: lots could be built on
and yet preserve the setbacks and not enoroich intothe pend
area,

Cr Gai.r stated that the qr ,, ,ng and utility plans are re-
viewed by the City Engineers,, that the drainage will be
altered by the roadway oo str ctioni and, the water will be
discharged to the wetiand area. He stated the DNR will
study these plans before issuing a permit will assure that
proper eater flow mils be maintained.. He, stated the lots
are suitable for development as proposed and meet the Ordift-
ance requirements with the exception Of the westerly lot
where a variance for '.lob width is quested
Engineer Sweeney explained that the Bassett Creek Watershed
istri r Will also revise the development plans for this
project.
Carmen Vethel. 1OZ10 "est Avenue forth, stated he wants the
wetland protected. He is In sight of the pond now and it
is his opinion that fill will be required and he wants to
knot, if DUR is in agreement. He noted that the Notice` he
received mentioned variance ` for lot` size. Coordinator
NoConn that the plans were modifled to meet the
standards so only the variance for lot width for Lot 9, i.&
requested.
Audrey Freus,, 2925 Quaker Lane, stated that she has talked
with Judy Boudreau, DNR, and was told that Graham Develop-
ment has applied for a Permit and was told that the devel-
oper gust prove there is no alternative for the roadway
alignment
Mr. Gain stated he has not talked with RNR for several, Meeks
so could not respond to tis. Boudr au's most recent cot-
ents* He stated that it is Important to note that the
roadway for 29th Avenue meets Casty standards and the Layout
providess a much .leeway to the pond as possible. He. stated
they could possibly pull it -further to the west, but must
maintain a ` safe curvature for the roadway, He noted that
the removal of the illegal fill will increase the capa i.ty
and size of the pond.
Commissioner Magnus inqu r,- ., if there is any way to move the
roadway and still w-Intaia<gr e curvature. Mr# Cain stated
that some slight Adjustments could be made.
Coordinator McConn stated that the € NR should not issue per -
wits without the development being approved by the City, ;but
the developer can make application to DNR. She noted that
the development plan responds to the Thoroughfare Guide Plan
of the City's Comprehensive pian and meets City
requirements.
Commissioner pauba inquired about an alternative such as
allowing access to Trenton Lane and 31st Avenue North and
eliminate ,the connection of 31st Avenue North and 79th
Avenue.

that in, most years the area was dry and had no stano n
water.

pond and Zetland preserved In response to Mr. Heggen, he
stated the pond area has not been dry since V71. He en-
couraged placementent df the roadway as far away as possible
from the pond and assure that the storm eater syst",10 will
provIide flow to the pond.
Chairman el e Wald confirmed tit the drainage will be
directed to the pend but explained that the pond is not part
of the City's Storm eater Drainage Pan.
Mr. Vethe stated It would be appreciated if the road ooul.d
be planed as far to the west as possible w1iich' would be a
reasonable compromise.
Mr. Co feZ stated he would likee any alternatives examined to
save the wetland, and that running 31st Avenue to Trenton
Lane may be appropriate.
Further discussion ensued on cul-de-sac's and roadway
alignment.
Mr. Lassen stated that the concern is the impact of the
roadway on the pend and that removing the fill is net a
concern..
Slam Held, stated he developed Timber Creek, and that the
fill that DNR has Mated is illegal and should be removed
was placed by Mr. Dempsey who has been asked for the last
two years to remove it.
Chairman Steigerwald confirmed that Graham Development'. .-till
be required to remove the fill.
Chairman Stelgerwald dosed the Public Hearing,

Heights subject to the 10 conditions as stated in the
September 16$ 1985 staff report and adding, Condition No. 11
to direct that the roadway will be aligned ,as far westerly
as possible, per approval by the City Enqineer..

Commissioner Stulberq stated that it Is the `oraaMlss n's
responsibility to follow the Thoroughfare Guide Plan; and,
the developer has assured they w ll cove the roadway as far
west as possible but will need to provide, smooth traffic
floe and assure the curvature;wil.l not be ha:zardous.-

stands'the direction to place the roadway, further to thestandsthe
crest and that trees should be planted on the east to buffer
and screen the pond.

the traffic which on occasion is backed up to Fernbrook
Lane. He stated that in planning his site for the "Burger '
11(ing" restaurant he was faced with the built-in traffic
problems. He noted there will be two national restaurant
c;hairts in the area with all the traffic going into this cul-
de-sac. He stated that truck traffic cannot man,-aver,
especially during the winter months4 ale stated it is imper-
ative that the City take responsibility to correct the traf-
fic problems or it could cause the businesses in the area to

Chairman Stc lgerwald inquired about customer complaints.
Mr. Sisk stated: they have had complaints which is the reason
th+-y have installed the second drive-throtigh to improve the
stacking. Mr. Sisk stated that perhaps the traffic could be
routed through to Claoier Lane over what is aiw undeveloped
property.
Chairman Steigerwald statk!d`he agrees with these concerns
and that the problem with the cul-de-sac should be brought
out in theCommission's recommendation to City Council.

solve these traffic problems.
Coordinator ReConn explained the approved General Develop-
ment Plan In response to questions from ; the Commission,

this Plan was approved how much traffic would be generated
by, the fast food restaurants. Coordinator McConn stated
that the improvements being Proposed by "Arby's will Improve
the traffic circulation on their Site.
Doug lWnn,%dy stated that they are increasing from 28 parking
stalls tr. 50 and that tie drive-through and access to the
building., wi, ie on the same side. He stated they appreci
ate the concerns regarding traffle problems in the aarea,
however, they don't want their,proposal delayed because of
these concerns. Chairmanpan Ste Berwald assured him this would
not be the case, but the City needs to address the traffr.o
problem3.. Commissioner Stulberq concurred aid stated he
agrees -,,,ith a connection to Glacier tune. Chairman
Steiger• ..d encouraged r.. Sisk to repeat, ono ins "o
